ILR: Shortfall by 60 days (not covered by 90 day concession)

Hi All,

I know this question has been asked a lot and I am sorry if I am duplicating the question.

I am eligible to apply for ILR on 1st May 2014(28 days before completing 5 years) but my visa expires on 14th March. The details are as below:

Visa Start Date: 01/02/2009
UK Entry Date: 30/05/2009 (118 days late)

Extension date: 14/03/2012
Current visa Expiry date: 14/03/2014

I have 3 options here:

1. Apply for Tier -1 extension first and then apply for ILR later
2. Apply for ILR directly and hope that the decision is taken after 1st May 2014
3. Apply for Tier -1 extension and if the decision is still pending on 1st May 2014, use a Change in Circumstance form along with ILR forms etc

Please help and suggest if this is possible.

If you read it through you can find the real examples of people who successfully obtained ILR by making early applications

However I have come across few people as well who applied an extension and later vary it towards ILR

So yea both options are workable.

Just wondering, if it still takes 6 months to process the ILR application?

Hi Ryans,

Which option did you select? I am also in the same situation. I got my Tier 1 visa on 01Apr2009 and entered UK in 17Jul2009. My current visa ends on 16May2014. So I am falling short by around 60 days.

I am thinking of sending a postal application for ILR around 10May2014 hoping that the decision may not be made before 17July2014.

Let me know the expert opinion?
