Claming working tax credits

Hi Every One
I am British Citizen,my wife and my son on spouse visa (before 9th july rule) i am claming WTC,CTC jointly,CB single,3 month ago i work full time and my wife take care of child,but i lost my job.Now fortunitly my wife get a job now she working full time i am take care of my child and looking for job.all change of circumtacies i tell HMRC by phone now they again start WTC.My question is now taking WTC are ok or its any wrong affect on my wife ILR appliction in April 2014? Because i am not working my wife is working and she is subject to immigration control (I am not).

for your quick reply.one more small question,i am going to apply ILR for them this year in April my wife Eranings net £180 per week,and we have 2 child.I am jobless.
CB.£33 per week
WTC. £57 per week
CTC. £112 per week
house rent i pay.£125 per week
Its enough Eranings?
we are living last 2 year together in U.K. No holiday outside from U.K last 2 year.what you thing its stright forwed case for same day peo service or some problem?

It makes no difference whatsoever who, out of the joint claimants for Tax Credits, is actually working, to trigger an entitlement to WTC. Para 6B of the Immigration Rules means, for you, that Tax Credits are not within the definition of Public Funds.

Never confuse the terms "benefits" and "Public Funds". Not all benefits are within the definition of Public Funds, and for you in your circumstances, Tax Credits, either or both, Child Tax Credit and Working Tax Credit, are not within the definition of Public Funds.

So no problem claiming that benefit.

Now i am feeling tense free.Because one of my friend make me really confused about that he told me now you cannot claim WTC because now you are not working your wife is working(you wife are subject to immigration control) may be HO refuse your wife ILR.

I concur with Amber_, your friend simply does not understand the technical legislation in play here. No problem with Tax Credits being claimed in your circumstances.

A, income is:

Earnings = £180
Child Benefit = £33.00
WTC = £57.00
CTC = £112.00

Total income = £382.00 per week

B, accommodation costs:

Rent = £125.00
Council tax = £30.00

Total accommodation costs = 155.00 per week

C, income support applicable amount:

An amount for a couple = £112.55 per week + 2 x an amount for children = £65.62 x 2 = £131.24 and Family element = £17.40 = £261.19

The total income support applicable amount for my family unit including my partner and 2 x children = £261.19 per week

A – B is expected to be equal to or greater than C. Check the figures I’ve used to exact ones and I think you should be fine as I’ve estimated your council tax.

I have £4500 saving in my bank account.Rent £125 are included with council tax so i save £30 also. i thing its straighfarwerd case.What you thing?
Can i use same day service or postel?
