Family visit Parents :Can they come after 6month spent in UK

Post by cruise tom » Fri Dec 27, 2013 4:56 pm

Hi All

Can my parents apply for 6 months family visit visa soon after there current family visit visa expires ?

Parents came to UK (currently in London) on 25 July 2013 :
Category - Family Visit Visa 6 month
Current Visit visa expiring on 14 Jan 2014.
Parents leaving back on 9 Jan 2014.

My question is can they apply for another 6 month visit visa on 20 Jan 2014 for example i.e. once there current visa expires and they have left UK on 9th Jan 2014 and they apply from Islamabad-Pakistan ?

Is there any restriction on applying visit visa soon after the current visa finishes as mentioned in above context.

Thank you very much for your support people

AFAIK, there is no mention that they can't, provided the purpose for their visit in such a short gap of the previous visit is justified to the UKBA.

Normally the visa is granted for 6months in every 12month period. More than this will not be visiting but will be living in the UK and will need a different type of visa.

Can you please point to a reference to this, that the applicant will have to wait 6 months before applying for another visit visa?

There is no rule, but see the section in the guidance from page 15 onwards:
Frequency and duration of visits
Visitors cannot live in the UK on a continuous basis even if this is punctuated by short absences from the UK to avoid overstaying.

sorry to ask this question, but I would appreciate help
My das has been visiting me for the last 8 years and spend one month at a time
now he got 10 years Visa
I want him till the end of the school term to help and support my kids
so he will stay initially for 4 months then will go back for the eater holiday and then will come back for 3 month till July 2014

this is the first time he spends that long time in uk.
will that be a problem at the immigration border?

Please advice

Possible ban, nothing you can do apart from make sure they visit as genuine visitors not looking after/helping out with babies etc, which is work/living here and not just visiting.

Basically don't take the piss and all will be fine...

The Home Office does not consider a visitor coming to the UK to assist relatives with child care as employed, if all the following are true:
 neither parent is in a category leading to settlement  neither parent is able to supervise the daytime care of the child  the situation or position is temporary  they are a close relative of the parent, for example:
o a parent, sibling or in-law o they are a distant relative that has formed part of the family unit, or o they are the closest surviving relatives of the parents
 it is not simply an arrangement to enable both parents to take gainful employment or to study
 they will not receive any payment, other than for board, accommodation and pocket money
 they intend to remain in the UK for no longer than six months.

all of this apply to us as we are british citizen and not in a category leading to settlement.
is that right?
