I got my WP for 3 years initially (oct02 to oct05) but lost the job in Feb04 and my second employer applied for change of employment and it was refused 3 times due to lack of advertisement.
(HO also sent a letter that I don’t have to leave the country based on the decision and can stay until my first work permit expiry date-i.e Oct 05)
Since then I was looking for a job and found one before my visa was expired but went to my home country as I didn’t want to stay here after my visa expired and came to know my new employer got the work permit based on out country application and got a new entry clearance (work permit) and came back to the UK in 2 months time.
Since then I have been with this new employer (dec’05).
Now one agent is telling, I can apply for ILR?.
Can I ? ..I am not sure I am …coz there is a gap in employment.
What he told, since I was not out of country for more than 3 months, I can apply …is that true?.
Could you guys advise me?

Since the HO know that you lost your job in Feb 04 and were denied the WP 3 times after that, technically your ILR clock was reset on Feb 04 and you have been working illegally.Notsure07 wrote:I dont want to lie here. After i lost my job, i did work for for an emloyer.You can say illegally now.

But the solicitor told me I can't apply for change of employment since i lost the job Feb'04,which HO was aware of, but I can apply for fresh work permit.
I dont mind waiting for another 3 more years but want to know what the agent sais was corret or not.

i am not too sure about 2 months gaP you had mentioned.
My first work Permit was exPired in oct05 but my EmPloyer had aPPlied for a new wP before my first was exPired(Oct05).BUt it was apProved in oct06 and since my new wp was taking time to aPProve i didnt want to stay here after oct05. so i left the country & came back with extry clearence(work permit)=2 months gaP
why whould i apply for new wp now as i have been with this emloyer since then to whom the wp was issue?

This could be the reason why you are allowed to continue. HO assumed that you're still with first employer, they only refused changing your job to second employer.Notsure07 wrote: I had mentioned(in feb04) saying i was still with the first emPloyer all these troubles would not have come.

I never though that I would be eligible for ILR.
Since this consultant told me, I was slightly tempted and wanted to ask you guys.
I am happy & can carry on with my current permit, which I think legal.
May be if my fate allows me, I would get one after 5 years using my current permit.
But if you were in my position, would you trust this consultant, who thought I could apply as I was out of country for 2 months only, apply for ILR?
I value your advice.
