Briefly detained at Stansted with UK RC

Post by JulietSoul » Sun Jan 05, 2014 6:06 pm

Hi everyone,

Just wanted to post about my first experience on entering the UK with my newly received RC, especially since I have not seen a similar case when searching online.
My husband and I flew to Rome for six days. I had no issues entering Rome - stood at EU queue with my husband, showed RC and got no stamp in my Israeli passport.
However, last night when returning through Stansted (EU queue), something obviously came up in the computer when I went through immigration. The UKBA staff member asked me several times whether I had been refused entry to the UK - I never have. He then asked me and my huband to wait, sitting on the chairs by the immigration desks, held my passport and RC and gave me a slip of paper which stated that I was detained, but the reason why was not marked. He said he had to make checks. After about 15-20 minutes he said everything was okay but wouldn't say what was the issue in the first place. He seemed to suggest it had something to do with the fact the RC application was pending. He took back the detention slip of paper and wrote my details and the RC details on the back, and promised to update the system that I am OK, but he said it takes time so this could happen again.
I appreciate that in the grand scheme of things this is not a big deal and that I just had to wait, but I fear what would have happened if I had tried to travel before being granted the RC, with just a COA and a marriage certificate!
I had never before been asked to wait at immigration despite entering the UK several times. The last time before this I entered was through the Brussels Eurostar terminal, without an FP, asking for a code 1A stamp based on Surinder Singh. That time it was very difficult to get the stamp as the staff did not know the law and ended up taking the details of my husband's Danish passport (even though I explained to them that it was irrelevant because of McCarthy and that we were relying on Suringer Singh) - I am thinking that maybe they put a bad note about me in the system?
Is there any way of finding out what it was?
Would love to hear anyone's thoughts and if anyone else had a similar experiece.

Probably a marker was added to your file when you entered using the code 1A. Nothing to worry about. If this happens again at the border, ask for the Chief Immigration Officer and ask for the marker to be removed.
Check the FAQ before posting!
Citizenship (adults, children, passport)
EEA (EEA FP, RC, PR, Surinder Singh)

Why would you use the Surinder Singh route if your husband is Danish?

I would write a letter of complaint. There is a complaints procedure available. Ask why you were detained and inconvenienced. Hopefully, the response will shed some light on the situation.

Sorry, I thought it was obvious, my husband is British and Danish indeed.

You don't have to worry about that.
Its a normal procedure. Ive been removed 3 years ago at Heathrow, then I got my RC last year and still they were detaining me every time I got to the UK Border asking me a lot of questions and checking on the system that everything was ok, I have to say its very annoying but yes, you are still on the system so every time you try to get into UK you will appear on it.

Talking about my personal experience, I was removed in 2011 and since then I have travelled several times and every time I was appearing on the system. Until last year, around November, I went with my wife to Spain for some holidays, we came back trough South End airport and the Chief Officer was very polite saying to me that every time I get to the UK border they make a petition to delete me from the system as they can't do it by themselves it has to be a major authority so sooner or later I was gonna be deleted.
Luckily, I went to spent Xmas and New year to Mexico, my country, some days ago trough Heathrow (which its been a nightmare cos they are not always polite, etc.) and I was very surprised when I got to the counter and the officer didn't ask me any question as they did in the past so I has been finally deleted from the system. He only looked at my RC, asked me about who is my EEA national family member, her nationality where was she and after answering all his questions he only said thank you and he let me go.
