ILR 144 Days outside of UK at a stretch with out Job in UK

Hi Guys,

I am due for ILR shortly, But i have a query before going i want to make sure what i am doing s the right choice.

I was away in 2010 for about 144 days at a stretch from April - 1st 2010 to Aug 21st 2010 . During this time i dont have any job and went to India for visiting family and taking course training and etc...
From that time now i was only away for 18 days in 2011 and 22 days in 2012 but these are paid leaves.

So over all around 180 days outside in last 5 years.

Can i go ahead for making the ILR application?

Which category are you applying from ? I guess it is Tier 1 . I don't think it's a problem . You can apply provided you are meeting all other criteria.

Yes dk2011 i am applying under Tier 1 General. i am just thinking of the long gap of 144 days. i meet all other criteria very much except this long gap.

We have only this rule
In UK BA it states that "During the continuous residence period, you cannot be outside the UK for more than 180 days in any 12 consecutive months."
I have not seen any limit for entire 5 years. Not sure if any exists.

I am also in the same situation as you more worse than actually. I was away for 163d without work in uk in one of the year...

When you are planning to apply? Have u met any solicitor for this?
