Hello everyone,

If an EU national is self sufficient with its own saving and plus on the income/funds of its non-EU national partner but EU national is also doing self employment too which means EU national is exercising treaty rights by 2 ways (self sufficient and self employment). In this case if EU national mainly rely on self sufficiency route to exercise its treaty rights instead of self employment and now some taxes are due on self employment then in this scenario an EU national is still qualified person even with outstanding taxes but on other hands with its own some saving and funds from non-eu national, the EU national is self sufficient. Never claim government benefits and have CSI too.

Yes someone can exercise treaty right as a Worker/self employed, Worker/self sufficient, Self employer/self sufficient, Job seeker/self sufficient

still for self sufficient you need to have Comprehensive sickness insurance for everyone

Yes mate, everyone has CSI and nobody never claim benefits. EU national has some saving in its account and also be supported by non-eu national funds too but EU's national's self employment taxes are unpaid. In this scenario where EU national is fully self sufficient with CSI covering all people but have unpaid taxes then does this still mean that EU national is still qualified person and there will be no problem for its non-EU's future application.

According to my very limited knowledge I think in that situation the EU will still be qualified person with self sufficiency. I believe Obie, amber, vinny, jambo and respect gurus will shed more light.

In above scenario, as per European Directive whether the EU national is still qualified person (self sufficient) even with unpaid self employment taxes.??

You can submit invoice / receipt If this is genuine self employed work

I haven't paid tax for year April 2012 - April 2013 yet doesn't mean i am breaking the law here. I've until 31st jan 2014 to pay TAX

Yes i know that self employment taxes deadline is 31st January. But my main question is that, since EU national was exercising treaty rights since start by two ways (self employment + Self sufficiency) but now because of unpaid taxes problem leaving self employment but is still on self sufficiency route which is one of the route of treaty rights. Then in this situation the EU national is still a qualified person (Eu national and non-EU national family members have sufficient funds, never claim benefits and also have CSI since beginning).

We talked about self sufficient in this thread. Read from the start: If the EEA national had some saving in the account already and then he/she can depend on the income of NON EU national to qualify for self sufficient

He/she can show that registered with HMRC, Invoice and Receipt , Payment in the Bank account .

when that EU national started self employment ? Didn't paid tax last year too ?

Can be both. nothing wrong is saying Self sufficient + Self employed
recently UKBA asking lots of documents for self employment. so to be on the safe side tick both in the Application form

I know someone ticked 3 in the application form > employed by a company + self employed online business + also had CSI
but not sure which treaty home office accepted

EU national not want to demonstrate self employment because of past taxes problem and it need so much paper work since EU national's personal account has saving, non-EU national savings and CSI since start which can easily demonstrate self sufficiency.
1. Is that alone (self sufficiency) not good idea without mixing self employment??
2. will ukba ask for tax repayment even EU national is exercising treaty rights by being self sufficient??

1 Not a problem at all

2 No you don't need to mention it. Tax issue may come when he/she apply for British Citizenship ( they do check HMRC if paid TAX, Insurance or Council Tax, court fines )

I guess that under EU directive 2004 the time spent under EU route the non-payment of tax and non-payment of bank money does not affect a self sufficient EU national as long as the EU national has its own saving+funds from non-eu family member+csi. Isn't it?
