ICO/ PIO for baby born in UK

Post by mansoniakki » Sat Jan 11, 2014 10:52 pm

Hi
I am based in UK and recently got ILR. My daughter born in UK, 2 months before I got ILR.
I am applying for her British Citizenship followed by British passport for her.
Is my daughter eligible for PIO or OCI card after getting her British Passport.

I am asking this because I have heard that we need passport surrender/ neutralization certificate to get PIO/OCI card whereas in may case my daughter never had Indian passport.

Hi
Update on PIO card of my daughter

I applied for pio card for my daughter this month and they returned the application saying that in nationality of applicant I have written Indian so I need to submit her Indian passport surrender certificate.

For your information my daughter born here in UK and after 3 months of her birth I got the ILR. She got her British passport now.

My question is that in nationalty on her PIO application form what should I mention Indian or British. If I mention British then will they ask for any document to prove her British nationality at the time of birth.

Or
She is not eligible for PIO

Me and my wife both are still Indian.

In my opinion you should leave "8. Nationality at the time of birth" question blank or write - child was eligible for Indian citizenship under section 4.1.a but the birth wasn't registered with HCI.

Hi

I am in very similar situation...Currently have a ILR(Parents) and eligible for applying citizenshio but we have decided not to apply for it.

My child was registered as British citizen under MN1 application form.

Can my child apply for OCI Card or PIO?
We did not apply for indian citizenship or surrender certificate for a child. Do we need to apply for surrender certificate.

Please reply.

Thanks
