ILR for myself and my wife

Post by rohin123 » Tue Jan 14, 2014 2:58 pm

Hi,
Both me and my wife came to UK on independent tier 1 visa. I entered UK on 1 Jun 2009 and she got her visa in mid jun2009 and entered UK on 1st Sept 2009. Now I understand , I would be eligible to apply for ILR from May this year onwards. Can I apply for my wife as well at the same time (as dependent) or she needs to apply independently ? When is the earliest she can apply as her Tier1 runs out in mid Jul 14 ? THe reason we prefer to apply together is that she's pregnant and wont be working and getting any pay from Mar 2014 onwards which might hamper her application.
Appreciate your help in answering my questions.

Thanks

She will need to apply independently for ILR as she has not been in the UK as your dependent. She can apply 28 days before the 5 year qualifying period.

Did she enter the UK within 90 days of her visa start date??

Yes, she entered UK within 3 months of her visa start date. So when is the earliest date she becomes eligible for ILR ? Also, the fact that she wouldn't be earning any income from Mar 2014 due to child birth change anything ?

She can apply up to 28 days before her visa start date under the 90 day concession.

Not too sure about maternity though.

Just to confirm , is the visa start date for her original Tier 1 visa or the start date for the Tier 1 renewal ?
