Need help about discretionary leave

Post by JOHFR2014 » Sat Jan 18, 2014 10:08 pm

Good evening board members and JTK, I am silent follower of this forum, but JTK 'S post prompt
me to register on 16/01/2014 because his initial application on discretionary leave is nearly like my FLR(O)
application process.
my immigration history is as follows. I came to UK in Aug 2005 as a
student from Gambia and I was on student visa up till end of 2010. I
got post study visa in 2011 which expired in April 2013 . My wife joined me
in UK from Gambia on Aug 2006 and my two children ( now age 13yrs
and 8yrs respectively joined us in 2007.The third child was born here in UK
in 2010. I put in FLR(O) application in 2013 when my post study visa
was about to expired, we applied as a family unit like JTK( JTK and his family were granted then)
and we were refused , luckily we got appeal right. Two of my children
will be 7years in UK this year Aug 2014 and I will be 9 years in UK by AUG 2014 as well . Presently I am using a solicitor
for the appeal.
My question is I need help about how to based my appeal
on so that the appeal can be allowed in terms of any case to use in
terms of human right issue or any relevant cases. your reply will be highly appreciated.

Surely your solicitor should be able to answer this? :?

It seems my solicitor is very busy and I do not want to leave everything to her and i need any precedent cases I can use because I learnt that whether your solicitor represent you or not , the applicant need to say something to back his/her appeal at appeal hearing. I will be grateful if any relevant cases can be forwarded to me or help me get in touch with JTK(A NEW MEMBER) whose case similar to mine.
many thanks

Good afternoon, my friends and other board members, i will be grateful and glad if someone can help with my query,i am a silent member of this forum but i need urgent help concerning my FLR(FP) based on 7year rule/private life which was refused recently without right of appeal. We are planning to go for judicial review. We applied as a couple ,two of my children have leaved continously in UK for more than 7 years as at the time the application was submitted. Do we have a winning case if proceed on judicial review because it seems most people on these forum got their visa after going through judicial review?
Many thanks ,your urgent reply will highly be appreciated

How did the Appeal go.

Was it dismissed, and was the matter referred to the Upper Tribunal.

Thank you for the prompt reply , the appeal for FLR(O) application was disallowed and we were given right to go to upper tribunal but in process we put in fresh (FLR(FP) application when we believe we have more grounds and this flr(fp)) was refused without right of appeal and that is why we are going on judicial review
