Tier 2 to ILR ?

Post by tier2_applicant » Thu Jan 23, 2014 3:03 pm

Hi,

I came to UK for my master's degree in Sep 2008.

From November 2010, I started working with my current organisation on Post Study Work visa.
In around November 2011, when my Post Study work visa was coming to an end , my current organisation applied as a sponsor for me, which got approved in Jan 2012. My Tier2 company sponsored visa is valid till January 2015.
If my organisation provides me another 2 years of sponsorship - will I then be able to apply for ILR in late 2016 (having spent 5 years on a work visa in UK, first year was as a student, 2nd year I was working part time) ? My current salary is £31,000.

Thanks.

you will become eligible for ILR in Jan 17 (and can apply within 28 days of your 5th anniversary on T2G).

In Jan 15 provided your sponsor wants to continue employing you can get an extension for up to 3 years.

Thanks Manci,

Appreciate your help. What if my salary doesn't change till Jan 2017. Will that be an issue ?

you have to have an "appropriate salary" for your job SOC code as given in the codes of practice both for the extension and for the ILR application:

Hi manci,

Thanks again for clarifying this. I think that my first tier 2 application (in 2011/2012) was under the SOC code 2423 (Business Analyst - my job title) the salary for which according the list you posted is 29,500. My current salary, as posted above is more than this.

So I believe that unless this salary figure changes in the SOC codes list, then it should be ok for me get an extension and ILR after that...........?

Thanks
