TIER 2 to TIER 2 CHANGE OF SPONSOR NEED LABOUR MARKET TEST?

HI ALL,

my sister is currently working as an accountant in a small firm under tier 2 general. However an employer is willing to sponsor her and she is ready to go ahead. but the employer is only doubting one thing??

DO THE NEW EMPLOYER HAVE TO CARRY OUT RESIDENTIAL LABOUR MARKET TEST? ?

IF YES, is there any possibility for a waiver? ie is there anyway to NOT carry out residential labour test as the new employer dont want to go through this hassle.

So it does mean that it requires rlmt. ??? its a extra headache for my new sponsor now.

I am in the same situation. However, in my case, I hold a Master's degree from a university in UK. This is to say I satisfy:
1. I have been allowed to stay in UK in the past on Tier-4 student visa (But this was 4 years ago, does this still hold good?)
2. I have been awarded a master's degree by a university in UK (this is 4 years ago - does this still hold good?)

Also, my new employer is sponsoring a Chinese national on Tier-2 visa; good news they have a CoS. Does this mean the employer has to apply to UKBA to increase the number of sponsorships he can provide? If so, please let me know the procedure and how long it will take?
