Hi all,

I am currently working in a fashion retail company for just over 6 months and earning 16000£ annually. My company has Tier 2 A rating certificate. I am doing Merchandising Admin Assistant but I am a computer engineer with MSc of engineering business management. can you please help me if I am qualified for a COS. Also my company can be easy with my job description if it is required.

i am mostly concerned with my job title as it is not NQF6 but UKBA website says the following;

The job must be at or above National Qualifications Framework (NQF) level 6 (or the equivalent in Scotland) - or:

at NQF level 4 or above if the migrant is already in the UK under Tier 2 (General), Tier 2 (Intra company transfer) or a work permit if that permission to stay was granted under the rules in place between 6 April 2011 and 13 June 2012; or
At NQF level 4 or above if the migrant is a Croatian national; or
at NQF level 3 or above if the migrant is already in the UK under Tier 2 (General), Tier 2 (Intra company transfer) or a work permit if that permission to stay was granted under the rules in place before 6 April 2011

I have applied before 6th of April 2011 so if I am NQF3 Can I still be qualified?

since you want to switch from T1 PSW to T2G the job has to be at NQF level 6. It is the job that matters, not your qualifications. What you quoted in way of lesser skill levels only applies to those who are already on T2 (and you are not).

Try to get an NQF level 6 job where you can use your qualifications, be it in your present company or elsewhere, and note that the min. salary has to be £20,300 or the appropriate salary according to the job SOC code, whichever the higher.

You are settling for way much less than your qualifications

£16000 a year for someone with MSc?

hi thanks for the explanation. I do understand the only difficulty will be the salary part they could probably state higher salary in the COS. will I need to show my payslip during my application. can you briefly explain me the process of application. or if I get payrise now or just before my application can I still apply?

I know I am earning less than my qualification but it was the only one I have found and I needed money.

are you sure your job is a level 6? look up here, if your job is on the list, then u can ask for appropriate salary and get a COS, if your job is not on the list, you should try and match your responsibilities with any other job. but it has to be NQF level 6. http://www.ukba.homeoffice.gov.uk/sitec ... orkers.pdf

that's the thing there is no job matches with my responsibilities as Merchandiser in the list just
soc 2010 3534 - finance and investment analyst and advisers
and 3545 - sales accounts and businss development managers

slightly matches.

the CoS has to be for an NQF Level 6 job with appropriate salary but only be from the work start date stated in the CoS. Your present job and salary are not relevant
