Eligibility for ILR

Hello

I am currently working in the UK on Tier2 ICT Long term Visa.

However I would like to know if I am eligible for settlement in the UK, i.e obtain ILR.

My first Tier 2 ICT visa stamped on the passport was on dated 31st of March 2010.

However, I landed in the UK on 10th April 2010.

According to the changes in rules of Tier 2 ICT Visa, i.e applicants in place after 6th April 2010 are not eligible for ILR.

I'm quite confused with the above rule.

Can you please clarify on my eligibility to obtain ILR?

I have leave to remain until 2016.

You applied before the rules change - that's the important point, the fact the you entered after (or even if your visa was issued after) the change does not affect you. So yes, you would be eligible (subject to meeting all other criteria).

I am very happy to know this.

And one last question on my dependents eligibility for ILR.


My Dependents came to the UK and stayed with me during the following dates as follows:


27th March 2011 - 30 April 2011


22nd June - Now


I will finish 5 years of stay in the UK by next year and will be eligible to apply for ILR.

Can my dependents also qualify to apply for ILR in the next year along with me. Or otherwise, should they also complete a period of 5 years to be eligible for ILR?

yes they will qualify for ILR at the same time as well.
