ILR needed for child born in UK?

Hi,

We are going for ILR application next month. Our son was born here and he holds Tier 1 dependent visa. Since we were short of 4 months for 5 years we had taken an extra extension hence we have visa for 2 more years. I am thinking to not to file ILR for my son and once we parents get ILR, we can apply for his passport and hence save the ILR fees. Is this ok as per the rules?

Yes it's ok, but you'd have to register the child as British (section 1(3)) before applying for a passport.
