ILR WHILE WAITING FOR APPEAL

Hello All,
I need some advice for my 10 year ilr application.
my visa expired on 5th August 2013.
my 10 year was completing on 24th Nov 2013.
my lawyer filed FLRO application base on private life which was refused and i have been granted appeal for june 2014.
now that i have completed 10 year in uk can i submit my 10 year ilr application
this is what i have been advised by one solicitor and another solicito claim i cannot.

i also had 2 exam in dec 2013 which was mentioned in the flro app.

please help as i am so confused as i am getting different views.
