Combination TIER 2 + Tier 1

Hi

My friend spent 04 years 03 months on tier 2 visa. Now he switch his cateogary to Tier 1 entrepreneur.

Can he eligible to apply for ILR combination of five years?

How much investment he have to show during 08 months of TIER 1 entrepreneur visa for ILR?

You should talk to immigration lawyers and read the ILR application form to see how it's calculated. I have been told previously that once you switch from Tier 2 to tier 1 the 5 year clock restarts and you must satisfy the condition based on your T1E status.

@ soma7474, if anyone switches visa categories, then they will have to spend total of 10yrs to be eligible for ILR unless they meet the settlement requirement of their current category. In your friend's case, he will have to either spend 3yrs (special arrangement) or full 5yrs on Tier1 entrepreneur visa before qualifying for ILR.

Can you apply for settlement?
To be able to apply for settlement, you must meet 5 requirements.

1. You must currently be in the UK under Tier 1 (General).

2. You must have spent a continuous residence period of 5 years here in any combination of the following immigration categories:

Tier 1 (General)
Highly Skilled Migrant Programme
work permit holder
innovator
self-employed lawyer
writer, composer or artist
Tier 2 (General)
Tier 2 (Minister of religion)
Tier 2 (Sportsperson)
Tier 2 (Intra company transfer), if your permission was granted under the Immigration Rules in place before 6 April 2010


As per my understanding he can apply within five years with combination of above mention categories.

Could you tell me i am interpreting the contents right or wrong?

Yes soma you are right. It is clearly mentioned over ukba website that you need to spend 5 years in any working visa category like you mentioned above to meet the continuous resident requirement for ILR.

@ soma7474, I think that you are right as I got it mix up. I think your friend should send an email to HO to enquire more and also he should consult professional lawyers on his case.

@ soma7474, you have already provided the reference yourself with the exemption that tier1 entrepreneur is not included in the list, but I believe that it might be possible for your friend to combine it with his previous years on tier2.
