Hi

seniors and gurus

Here are my details , please confirm that I am eligible to apply for ILR :

Putting every detail even student one is not so relevent

2005 to 31st March 2009 = on student visa (few extensions)

applied for Tier 2 (G) with in time and got as follows:

Date of Issue = 09-04-2009 To = 09-04-2012 ( 3 Years)

Extension of Tier 2(G) sent in time and got as follows:

Date of Issue = 28-05-2009 To = 06-04-2012 ( 3 days less than 2 years I think)

1- Can I apply 28 days before completing 5 years ( 28 days before 09-04-14, even though I have 3 days short)

2- My only worry is above date 28-05-2009 if i count from that date then I will be more days short. Or should I count from where the last visa ended i.e 09-04-2009??

3- My understanding is that I can apply any time after 15th march 2014.


Please advice and confirm

You got Tier 1 in 2009 and also applied for extension in 2009 itself ? That sounds incorrect to me .

sorry my mistake, here are the correct dates

Applied Tier 2(g) in March 2009 and got it as follows:

Date of issue= 09-04-2009 TO = 09-04-12 (it was for 3 years )

Applied Tier 2 (G) Extension and got it as follows:

Date of issue= 28-05-2012 TO = 06-04-2014 (3 days less than 2 years i think)

NB: Mine is Tier 2(g) not Tier 1.

Questions are

1- Am I right to think that I can apply for ILR 28 days before 09-04-2014 (my visa is upto 06-04-2014 though)
2- at extension visa issue date is 28-05-2012 will this be an issue while calculating 5 years as last visa was upto 09-04-201 so there is gape bw 09-04-2012 to 28-05-12 (gap is from ukba i applied extension before time)
3- Am I okay to book PEO appointment after 15th March 2014 anytime.

Generally , you should have a VISA to cover whole 5 years period and you can't apply more than 28 days before your fifth anniversary. Bring it to the attention of moderator/gurus as this is little bit tricky.

For the Kind Attention of Gurus/Moderators and Seniors

What I understand is that only work permit visa used to be of 5 Years. When Home office introduced Tier 2(G) then it came with that it will be given FIRST for 3 Years PLUS extension of 2 Years completing 5 years this way.

Please shed some light and advice me ( i thinking to Book PEO today soon)

Further to Earlier post I was only worried about the Extension Date of visa issue when DK2011 noted it .

Please Advice

Added 4 years, 11 months, 2 days

Result: Thursday, March 6, 2014

You can apply any day after March 6, 2014

He meant his VISA doesn't cover whole five year period and it is 3 days short . Now the question is one can apply upto 28 days before their fifth anniversary regardless of whether one have VISA cover for full 5 years or not ?
e.g. Some person VISA is expiring 27 days before fifth anniversary. Can he still apply on the date of expiry or a day before ,especially in PEO ?

DK2011 and UKBAlovestory THANKS a lot for both of you.

Infact my question was about visa issue date of extension, which is 28-05-2009 ( i thought the gap bw when first 3 years expiring i.e from 09-04-2012 to 28-05-12 will be excluded from 5 years or not). which I came to know by the discussion that it doesnt matter because thats upto UKBA as they issued 28-5-2012 AND actually what will count is START date of visa Tier 2(g) which is 09-04-09. And so adding 4 years 11 Months and 2 days brings it to 11-03-2014. So I can apply anytime after that. (this is what i understood from UKBALOVESTORY reply) Am i Right?

@ DK2011 ,I will do definitely.

at the moment even at 12:00 at night I am unable to book PEO appointment at Sheffield and Solihull. it shows appointments for Croydon and Liverpool for example which means appointments for that day has been released (i was trying to book PEO appoint for 20 or 21 March), but it seems it goes WOOOH as soon as they release SPECIFALLY for these TWO PEOs Centers (Shefield and Solihull).

I will try again tonight and see how it goes.

Have you managed to book appointment for PEO solihul,
I am unable to book one , Incase you have booked can you please let me know how did you manage to get one
