ILR 10 yeas EEA family member pls help

Post by SKV » Sat Jan 25, 2014 2:39 pm

Hello everyone,

please can anyone advise.

I have applied for ILR on 16/09/2013, 4 months ago. I was 7 years as a student, 1.5 post study work and 1.5 as an unmarried partner of an EEA national.

I have just read that I have to show that my partner is exercising treaty rights, I only sent a letter from him saying the we are still together, certified copy of his passport and proof that we are living together, I didn't provide p60 or payslips as my lawyer didn't mention this. Now I am so scared that the application is refused cos I didn't send proof that he is exercising treaty rights. If they require this documentation. Would they contact me? Or shall I send this extra documents as soon as possible?, I guess they are about to make a decision cos it has been four months.

Please help, I am really worried.

Hello everyone,

I am in a similar position. I have already applied on 16/09/2013 for ILR having been 1.5 years as the unmarried family member of an EEA national. I didn't send any of his payslips, just a letter from my partner confirming our relationship and proof of cohabitation. I posted on a different forum if it is possible to send these extra documents now as it has been 4 months since they received the application. A moderator has kindly replied that I should send this ASAP.

I do not know which address to send them to.

I hope they will contact me if they require this info.

could they refuse without asking for extra documents?

Send the extra information to the same address as you posted the SET(LR), Durham I believe. Send via recorded delivery and keep a copy of what you send with proof of postage.

Dear Mate,
I will be in the same situation soon in April,
I got few question to ask,
1 . What this Exercising Treaty Means , does it means that your EEA National is currently working in the UK, because she is working part time.
2. Does my wife have to do Apply for PR ( EEA 3 ).All she did was WRS when she came to UK and Started working in April 2009, before that she was studying when she came in 2008. ( EEA National )
3.Will it be ok , when I am sending my application , I should send My Wife ( EEA National ) P60 of work, she is been working from last 5 years without having any out work or claiming any job seeker allowance or job search. Or do I need to send extra documents as well , like Employer Letter she ( EEA National ) is working with from last 5 years .
4. What extra documents are required from me.
I know few things following,
* all old passports and current one
* Life in UK Test
* English Language Test
* Last Few months Bank Statement
* Last 3 P60s of mine ( Optional ) or not.

I will be grate full from your Update from Your Application , and please do correct me if i need to do more things before i send my application.
I want to be mentally prepared for everything I required to do.

Thanks
Khan

Hello Khan.

I have revived my ILR yesterday.

I am not an expert but for the period you have been as a Family member of an EEA national you need to provide your partner's P60s and latest payslips. I also provided my partners bank statements and proof cohabitation. as I said I am not an expert but that's what I provided and it worked for me.

Good luck!!

Dear Mate

So in Conclusion all I need is ,
* All ten years Passport
* Life in UK Test ( Passed 2011 )
* English language Test (Passed 2014 )
* My Bank Statement
* WRS ( EEA National original Certificate )
* EEA National Work History for from the time She was issued WRS March 2010 ( e.g. P60's probably , plus pay slips )
* Last 6 months Wife Bank Statement ( EEA National )
* Tendency Agreement Of Our Home
* Original Marriage Certificate ( Optional May Be )

So hopefully it means I will be Eligible for Long Residency ( 10 Years ) Rule.

Hello SKV,

Can you tell that whether did you submit the original passport/ID card of your EU national partner or just the photocopy of EU national passport/ID with application? Thanks

Dear Mate,
Actually I have the same question as well , do I have to submit my wife ( EEA National ) Original Passport or ID Card as well.
And how much Time your ILR took place, duration of your application process, so I can get some rough idea.
