Less than 12 months period - Previous Earnings

Can the period claimed be less than 12 months to correspond with evidence? e.g payslips

If an applicant has earned enough in 11 months in the last 15 months to gain maximum points for previous earnings, can he claim a period less than 12 months?

I had payslips from a certain date - to a certain date (less than 12 months), but in the last 15 months.

So, I claimed a period less than 12 months to correspond with the same as one needs payslips for the entire period claimed. The tax document (12 months - 1 Tax year) overlaps that 11 month period.

The case workers at HO try to find reasons to reject, hence my concern.

Please Advise.

As long as the 12 month period falls within the 15 month window and is continuous, there should not be a problem. If you score the claimed points by including just the 8 or 11 months for that matter, the Case Worker in normal circumstances would not reject your application. BUT he might want toknow as to why evidence for entire 12 month duration has not been submitted ( whether you became self employed etc. and therefore you should have provided a different set of documents).

I hope you have covered that aspect in your cover letter and have submitted the proof that you were salaried throughout the duration.

That's fine. I claimed on less than 12 months. The most important thing is x months in the past 15 with x maximum of 12.

I received my HSMP last week.

My friend also applied for points based on earnings for a 10 month period (he didn't have evidence for the other two). His application was accepted.

I am a bit concerned by what you mean as 'continuous'. For example, I intend to choose a 12 month period between 1 June 2006 and 31 May 2007. I worked in Australia from 1/6/06 until 25/8/06, then had a break when moving to the UK, then worked in the UK from 16/10/06 until now. I easily qualify in terms of earnings (esp if it's done by pro-rata earnings given I have spent the majority of time in the UK), however does it matter that I had this ~6 week break in between countries and jobs?

no it does not matter.
continues means a date interval of maximum 12 months.
there can be weeks in this interval that you did not work and earn. it is OK.
good luck

however does it matter that I had this ~6 week break in between countries and jobs?

EC = entry clearance, the step that follows the approval.

Ok, so this info is all new to me... I just want to clarify....

You can claim up to 12 months of previous salary to meet the earnings criteria, and those 12 months must be continuous and within the past 15 months of the application date?

If that's true, Phew! I thought I would have to get my employer letter RE-issued because it has been 2 months since it was written (I've been waiting for other pieces to come in.)

Earnings period can be:

any CONTINUOUS period up to 12 months in the 15 months before the date the application reaches HO.
