How to register child as British born abroad

Post by SSWSZ » Thu Feb 06, 2014 11:35 pm

Hi.i need some information for my friend child .i read many topics regarding this matter but the problem is no one ans it in detail so plz kindly reply me it's very imp.
My friend married to British citizen came uk in 2010 .her child born outside uk in 2009 to British father.she is in uk till now .her ILR rejected because her lawyer never mention that she has to do life in uk so ho gave her 2.5 year visa and mention on rejection paper that when ever you done life in uk just apply and we will issue u ILR all other things are correct .she applied for her son as we'll and he also got the same visa now my questions are

1) is it necessary to get ILR for her son if not how can we register him as British .because they apply for his British passport and passport office told then that he is not eligible for British passport .
My friend has 2 more kids born in uk and already British .

Plz plz senior member ans me in detail she has to apply next month because they are planning for a visit to home country and need advice as they don't want to trust any lawyer

Why did the Passport Office reject the application?

Is the father British by decent? What visa does the child hold at the moment?

Child may already automatically be British, if the child's father was British otherwise than by descent when child was born.

The Passport Office may be correct, if neither child's father nor grandfather was in the Crown service.

Child may be entitled to register under 3(2) or 3(5).

The latter is better, after child lives in the UK for 3 years.
