ILR or Extnsion

Hi All,
Request your candid advise on my case as shown in the details below;

UK Tier1 Entry visa approved date : 15th November 2008
First Entry to UK on the Visa : 10th May 2009
First Renewal was 28th December 2011
Expiration of Visa : 28th December 2013
Date I feft UK for the first time : 12 July 2009 and came back to UK 12Sept. 2009 (90days)

Date I left UK for the second time (Unpaid holiday) : 14th Jan.2011 and came back to UK on the 30th Jan 2011 (15days)
Year1 15 Dec 2013 14th Dec 2012
Year 2 15th Dec 2012 14th Dec 2011
Year 3 15th Dec 2011 14th Dec 2010
Year 4 15th Dec 2010 14th Dec 2009
Year 5 14th Dec 2009 14th Dec 2008
My questions are:
1. can I be granted ILR on compassionate ground as the reason for coming late to the country was due to the fact that when I wanted to apply with my family, I was told the money I kept in the bank for 3months was not enough for all of us. I had to apply only and when I got the Visa it became very difficult for me to leave the family as my children couldn't understand why I had to leave them. I do not have any other reason other than this. Is this a tenable excuse.

2. If the answer to my first question is that I'm not qualified for the ILR. The next question is that I brought in my family on the 15th November 2012, is it possible that if I apply for extension, can they be granted a four year visa which is required to complete their 5year stay while I'm granted a 1 year visa which i can apply for ILR as soon as I'm due. Just want your advise as there is a huge financial implication if they are granted 1 year extension. Or is there any way I can go about it to avoid paying such a huge amount of money.

well

on one hand, compassionate circumstances related to ABSENCES and late entry to the country is not an absence

however the document here which I suggest you read

seems to suggest that late entry delayed by no more than 90 days will not be regarded as an absence

by implication it then follows than entry delayed more than 90 days, is an absence -- and hence could be for compassionate reasons?

if you go for it i suggest you lay out this very reasoning in a cover letter

If you initially arrived more than 90 days late, then the start date of your qualifying period for ILR is the initial date of entry.

hi i also came late in the uk after gettinhg the visa.can i go for an ILR.please suggest.
