Definition of qualifying period for ILR / PR

For Example: Tier 1 General Migrant visa was issued for first time on 1 April 2009 but the person reached the UK on 27th July 2009; i.e. 118 days after the Tier 1 visa was granted. Does this disqualify the 5 years continuous period? Still not exceeding 180 days in that year.

The Tier 1 visa was extended on 28 February 2012 for 2 years expiring on 28 Feb 2014. If we calculate backwards and imagining the date of application for ILR on 5th Feb 2014the consecutive periods would be as follows: (as explained in Home Office website):

1. 5 February 2014 to 6th February 2013
2. 5th February 2013 to 6th February 2012
3. 5th February 2012 to 6th February 2011
4. 5th February 2011 to 6th February 2010
5. 5th February 2010 to 6th February 2009 (please note that 1st time the Tier 1 visa was valid from 1 April 2009 and the person entered on 27th July 2009; i.e. after 118 days from 1 April 2009)

There is no issue of 180 whole days absence in first 4 years. In the last year i.e. 5th February 2010 to 6th February 2009 the person entered after 118 days since the first visa was effective and after that until 5th February 2010 the person did not leave the UK.

Does this person qualify for applying PR? Or have to extend the visa and then after 118 days apply for PR? I hope I have explained it correctly. If you need any further clarification then please do let me know.

The earliest date to apply is June 30, 2014. An extension is required

Thank you. I will extend my visa and apply for PR in June 2014. Its just that I have to pay for extension and again for PR but I guess there is no option. Thank you again.

My date of application was October 2008 but my successful visa was granted in 2009 June so when does my qualifying period start from is it date of application or from the date when visa was issued.. Plz can someone help in understanding

The visa issue date. If you were already in the UK then you can go for ILR in June 2014.
