King2be is right, when the new rule came into implementation it was clear that 6 months bank statements and 6 months payslips were required, still you only sent 14 and kept hoping it will be fine. It turned out it wasn't fine and you ended up sending more evidence post your application date whereas one would say BHC might have been interested in seeing evidence pre application date (6 months upto application date). But again, it makes sense to send fresh evidence relating to your current situation which you were advised by the solicitors and you did so. Who knows what is right or wrong, in your case not even the solicitor.

To some extent I do agree with you on the fact that knowing BHC has strict rules we still end up making a mistake in our application and blame BHC for taking too long and when we are asked for additional documents we get shocked why we. If all our documents are fine, meet the requirements and we don't chase BHC than this could make the process quicker for us all but no we are impatient and end up bombarding BHC with emails.
You are right this forum is for timeline and to help people understand the process, but you could have said that in a nice manner.
I plan to wait for the March hearing and if it is not in the publics favour, i will withdraw my application and reapply. I'll double check everything via this forum, as u lot have been a bigger help to me than some of these so called " solicitors" and " immigration specialists".

Everything i submitted was checked through by a specialist, that's what ticks me off the most.

as you can see below might be important to those who are on hold


As you may be aware, on 5 July 2013, the High Court handed down its judgment in a Judicial Review of the minimum income threshold for non-European Economic Area partners and dependent children under the family Immigration Rules. Those rules were brought in to make sure that family migrants coming to live in the UK would not become reliant on the taxpayer for financial support and would be able to integrate effectively. We are therefore pleased that the judgment supports the basis of our approach.

We do not agree, however, with the judgment’s assessment of certain of the detailed requirements of the income threshold rules. We are therefore pursuing an appeal against the judgment. This will be heard by the Court of Appeal in March 2014. Until the legal challenge has been finally determined by the Courts, where an applicant does not meet the minimum income threshold and there is no other reason to refuse it, the application will be put on hold.

145 days according to work day calculator, well over the guaranteed processing time. Either the application was stuck under a pile or they had to re-check aspects of the application.

Congratulations guys..

People have mentioned that letters have been sent out in December to say they are taking longer than their usual service standards so once people's applications get to a certain stage they are communicating this. So everyone should expect it to go over. They're not keeping this a secret or anything

Hey All, I'm a bit confused about my situation, and wanted to discuss with all of you about what i should do.

From the beginning, basically i gave in 14 weeks of payslips, which totalled to 5117, they states on tbe letter they sent me that they believed that this was all i have earned, despite me.giving them 6 months of bank statements and they could see a weekly amount going in. I gave in extra 7 months payslips and bank statements, yet they stated theu couldnt come to a conclusion.

The thing is now is that i don't understand how much they think I'm earning and if the financial requirement is lowered down will it come down to that "£5117" figure, that they stated.

Even though i should not be caught up in this mess and this court case, i wondered, would it be worth to reapply rather than to wait for March.

Any advice please, i would be very grateful, thanks

5117/14 = 365.50 is that how much you earn a week? There is no way that the minimum threshold will come down to as low as 5117 and to be honest the minimum income threshold can not come down below the benefit amount a couple could claim per week, I am not sure what the benefit figures are.

If you wait for March then you are clearly looking at waiting until November/December or even much longer before a decision is made on minimum income threshold. Once the decision is made then when will it come to implementation and when will it be your turn, assuming there are others in the queue before you.

In my opinion, you have most of the documents already prepared, get the latest payslips and bank statements, go spend couple of weeks with your husband, include copy of your ticket and passport page. Whilst you are there reapply and you know in sha allah with the mercy of Allah swt by 3 to 6 months you will have the visa.

You are more knowledgeable now then ever before so why not reapply and eliminate the mistakes that you made in your last application.

Jazakallah khair, for your advice, im looking to withdraw my application anyway, because i was so dubious about this whole situation, i think.im better off starting afresh.

Alhmdulilah, because of this forum, i have learnt alot.:)

Hello i am new to this web i find it really use full i wish i had known this web before i submitted application for my wife. anyway i submitted application on 08/11/2013 under process on 25/11/2013 i think its over three months now. Do you think i should start to chase them? Thanks :?
