Tier 2 General to ILR Continuous Period Calculation

Post by jalil » Thu Feb 13, 2014 3:18 pm

I am on a tier 2 general visa since June 2009. To date, I have been in the UK under this category for 4 years and few months and planning to apply for ILR in June.

My days spend outside of the UK as follows:
Year 1/ June 2009- June - 0 days
Year 2/ June 2010-June 2011- 45 day in one trip (paid leave for holiday- pay slip available)
Year 3/ June 2011- June 2012- 0 days
Year 4/ June 2012- June 2013- (47) of which 38 days (paid holiday- pay slip available) + 9 business leave
Year 5/ June 2013- now – 0 days

I am concerned about my continuous period can anyone help me out of this misery please and let me know if my continuous period is justified or not? Am I going to be face complication in my application because of duration of my holidays?

Many thanks for your help and good luck to everyone.

Kind regards!

Your absences so far are OK, they don't break continuity. By "business leave" you presumably mean business trip.

No more than 180 whole days absence are allowed in any of the five, four, three or two consecutive 12 month periods, depending on the category, preceding the date of the application for indefinite leave to remain (ILR).
