90 days concession rule

Hello Gurus,

Can you please clarify that 90 days concession rule (days between Visa stamping and Entry to UK) is applicable to everyone on Tier 2 regardless of their current visa validity or it can be used only if current visa is expiring before 5th anniversary of date of entry?

For eg,

Visa stamped in Jan 2010
Entry to UK in Apr 2010 (within 90 days)
Current visa valid until Mar 2017.
Do I need to wait for Apr 2015(date of entry anniversary) because current validity is until 2017 or can I apply 28 days before Jan 2015(date of stamping anniversary)?

It is applicable to every one . you can apply up to 28 days before your fifth anniversary i.e. in 2015

I assume that you mean I can apply 28 days before Jan 2015 (5th anniversary of Visa Stamping) even though I have my valid visa till 2017.

urw. I don't see any scope for assumption though . I had clearly mentioned 2015. I know your VISA validity.

Hello Experts,

I got my entry clearance as T2 ICT in Feb 2010 and switched to T2 General within country valid till 2017. My date of entry in UK was Apr 2010.
Can I apply 28 days before Feb2015 which means entry via T2 ICT and now on T2 G but taking 90 days concession?
