family bereavement travel query help!

Post by uiqbal » Sat Feb 15, 2014 11:25 pm

Hi,
I have a friend with indefinite leave to remain who is applying for naturalization soon.
He has travelled to his home country on expired passport due to urgent family bereavement with valid visa for the country. The entry date in to his home country is on the old passport and entry date back in UK is on the new passport. He got the passport renewed back in his home country within two weeks of exit from the UK and travelled back on the new passport.

I would like to know in terms of application for naturalization and citizenship, should this be all right.

Any help in this matter will be greatly appreciated.

Regards,
uiqbal

Not an issue. I hope he still got his old passport (although not valid any more) so he can use that as proof of his residence in the UK (otherwise, alternative evidence is required).

Is travelling on expired passport with valid visa not considered illegal? The passport he had was of his home country.

I didn't say he should use the invalid passport for travel just that he could use it as one of the supporting documents for the application as it would cover the years before his new passport (you are required to provide proof covering 5 years of residence).

I will rephrase my question:
Will a travel which was done in past on expired passport(this has been done now) but valid visa affect naturalization process, when the UKBA look at the exit and entry dates on the passport, with exit date being on the expired passport and entry date on the new passport?

Can UKBA object to this and can they reject the applciation?

Thanks for your help Jambo!
Can you please provide some information to sustain this, why would they not consider this as a problem?

Because it is not a problem. Why would you think it is a problem? It is not strictly illegal to travel on expired passport. Just difficult.

My ILR is in my old/expired passport while for the past 3 years I have been traveling with my new passport and every time I enter UK I show both passports.
3 years ago I exited UK and got entry stamp of another country n my old passport and while there I applied and got my new passport (biometrical). Upon return to UK my first stamp in my new passport was UK entry.
I am sometimes wrong.
