Tier 1 General ILR Urgent Quarry

Dear All,
I was granted my Tier 1 ( General ) visa on 17.03.2009. First entry Uk was 16.05.2009. 61 days late entry.
I got my extension till 17.03.2014. i had only 21 days absence from UK. I am planning to apply this week.
Could any one can confirm me that i can apply 28 days before my application expire.
