ILR dependant application

Post by sheraz_aries » Sat Feb 15, 2014 2:17 pm

My friend got his question below, would appreciate response from you guys:

I obtained Tier 1 (General) visa in March 2009 and got my I.L.R in Feb 2014. I got redundant in Dec 2013 and I am unemployed at the moment. However, I have all payslips for last 3 years from same employer.
My wife got Tier 1 (General) dependant--entry clearance visa from Pakistan in Dec-2013 which is valid until Oct 2014

Question: under which category/form I should use to extend her visa?

She may apply for a PBS extension and subsequently apply for (or vary it to) SET(O) (319C and 319E and Explanatory Memorandum > 7.17-7.21).

You'll only be able to extend as a PBS dep, If there is no income/insignificant savings, as FLR(M) has a Financial Requirement. Is your spouse working?

lynxukauq is incorrect regarding Varying to SET(O) as your spouse will need 5 years as a PBS dep, not 2.

My friend do have savings that he can show, but his spouse isn't working.

Do you mean is working allowed? If so, yes for both, but no Doctor training on PBS dep.

For PBS dep extension its only maintenance, there is no requirement to work.

Many thanks again Amber
Things are so clear now
Her Visa expires 12/10/2014 and because there is no income and employment requirement despite the fact I moved to ILR via PBS route, I planning to apply for her visa extension in October 2014.
Do you think, does that effect our application? are they going to make any changes in law?
Please let me know your views

D A
