Retain residence

i am married eu 2011/jan she has 2 nationality eu/moroccan and iam from morocco .now she want to divorce in morrocco beacauese we married there .

i have p45 30h a week proof she was working since 2011 and i have bills and joint bank acount 2011 .
i have p60 30 h a week proof she was working since 2012 and i have bills and joint bank acount 2012.
i have p60 proof 20 h a week she was working since 2013 and i have bills and joint bank acount 2013.
i have payslips 10h week from 2013 may /2012 jan .
and i have porof am working ful time since 2011 up to now .

now we are separet arornd 2months .

i can believe in our counter we will get divorce less than 2.5 month .


if will get divorce in may that s mean i have right to retain right after 3 years married by last payslip i have in jan/2014 and bills ?

There three things u have to prove them to get the right to stay here
1- you married lasted 3 years
2-live with her at least one year in uk
3- she is exersice treaty right in uk on the time ig divorce

So the third point is the most important so if she leave her work to divorce u in moroco thts to bad but if she go only for work paid holiday nd she will back thts ok

If i instead make sure she is working nd take week holiday nd divorce her in moroco while she working n uk
Or stay here nd make tawkel for morrocean lawyer to
divorce her as islamik married say



U have to convience her to divorce here nd u will pay for it

But if u sent payslips in jan u will be refused u must have payslips on the time devorce so ur divorce waa in may so u have to have payslips till may.

just i want ask some question please.


i have already rc card if i want send for permanent eea4 .


do period 5 years for permanent start from mariage date or residence card date ?

because my mariage date 2012 feb and residence card date 2014 jan . and she treaty right in uk from 2011 untill now.

You wrote in another post you married in Feb 2012 in Morocco. When did you arrive in the UK ? Your 5 year for PR will count from the date you first arrived in the UK and YOUR retained right of residence will start from marriage date so that's 3 yard after marriage

Please don't confuse us.
