Hello
i have been reading the post here, i have got some questions my partner (UK citizen) is claiming benefits i am subject to immigration control and cannot claim. i have been working full time (may 2013) but she has not informed the benefit organisation about my income until (feb 2014), i would like to know whats going to happen and if this would disqualify me from ILR.
she claims:income support, housing benefit, tax benefit, child tax credit (my name is on it but she is the claimer), carers allowance, child benefit (my name is on it but she is the claimer), disability & council tax benefit.
as at today when she informed the benefit organisation some of her benefits where put on hold and some where still granted.
please can you help me with some information

Hi Ranjeet,

Congratulations first.

I am thinking of applying next month but have a bit of confusion. My first entry clearance was of 27/04/2009 but current visa expires on 24/05/2014. As far as I can understand UKBA guidance, I should be eligible to apply for ILR on 28 days before of 27/04/2014. Is this correct or should I do it 28 days before my current visa expires i.e. 24/05/2014

Also, I arrived in UK 75 days after entry clearance, but that is insignificant because of 90 days concession rule.

I would appreciate if you could give your opinion on my case.

You can apply 28 days before completing 5 years of your first visa stamping date.

Thank you for your prompt reply. i thought the same. But guidance form stated as below, which confuses me. Because my visa was stamped in Nepal and I entered after 75 days.

5 WHEN TO APPLY
You and any dependants applying with you should
apply before the end of your/their permitted stay in
the UK.
There is a qualifying period to complete in most of
the categories on this form. It runs either from
- the date on which you entered the UK with a
visa
in the relevant category
; or, if you did not enter
the
UK with such a visa, from
- the date on which you were first granted permission
to remain in the UK in the relevant category.

HI Rajneet

I read your posts and congratulations on getting the ILR. You had previously posted under 5 year continuous period, the gap of one year in finding employment when you first came here. It took me six months as well so I understand that this was not a problem for you in getting the ILR. I do not have all P60s either.

P60 is not required for Tier 1-(General) to ILR. case worker expects you to submit last 12 months salary slips and bank statements. P60 and salary slips both are from same source (from employer). That is why if you are submitting last 12 month salary slips then there is no logical point to provide P60.


Yes, I year gap didn't affect my application for ILR so I can assume that you will be safe.
