Retention of Residency based on (Separation Agreement)

Hi All,

Following my previous post and with consultation from many people I have come to know that I cannot apply for retention of residence card if I do not have any proof of legally separated or divorce proceedings etc and I do no have that as we only separated last month.
Now my question is if we sign a legal separation document which means we no longer live together and agree on terms etc.Would I be able then to apply for EU5 Retention of residence card?as I am confused because according to INIS website it says:(You cannot apply on the basis of the dissolution of the marriage if divorce proceedings have not been concluded and a decree of divorce issued).So in other words according to INIS I can not apply for retention of card if we have not divorced..
To me that means that a separation agreement will not be accepted but I may be wrong..can any one please advice me on that with any information or personal experiences?

Separation agreement is not valid to apply for retention or rights.
You need to be divorced or if EU citizen have departed from State.

So in my case since we are not divorced but separated and with 5 months valid visa left what is my way out of this?do you have any idea?

Best way for you is need to get the divorce first, which you can get from Ireland and you do not need to go to the your wife's country........here is the link below for divorce from Ireland and it will take 4 to 6 weeks to finalize your divorce.

I got my divorce in 4 weeks and paid 900 euro.
