Hi
I will be applying for my husbands visa soon not sure when but just not sure if my case will be strong enough. I started working last year January 2013 but was earning £1176.08 monthly and my total gross pay was £1250 due to me earning less than 18,600 I hadn't applied for my visa, and was in search for another job. I was given a pay rise in November with a new monthly salary of £1273.64 and total gross pay now is £1560. I was told ukba will check the gross pay and workout my yearly pay. So if they use my gross pay for 1560*12 = £18,720 which is more than what they require. Is it safe to go ahead and get my papers ready for my visa or am I wrong about them checking the gross pay? If you could please let me know as I am unsure. Also, one other question I have a 11 month old baby through who I had been given child benefit since he was born and recently applied for child tax credit I received the letter back yesterday but they have given me working tax credit too. Which I didn't apply for but it is automatically applied for when you claim child tax credit will this affect my visa ?

Is your employment salaried? Benefits don't affect the application but they can't be used towards income for the purpose of the Financial Requirement.

Yes it is salaried I get paid the same amount every month which is £1273.64 which comes under net pay on my pay slip.

Your income will be calculated on your gross pay.
(Casa, not CR001)

If salaried for Cat A (6 months) they you would have to wait until the lowest month's wage slips x 12 = the Financial Requirement. Alternatively, a Cat B application could be made if in the last 12 months you actually earned the Financial Requirement.

It's only been 3months with my new wages that meet the financial requirement. So does that mean I have to wait more than 3 months to apply. I was planning on applying after I have 6 months pay slips. Which they require for the visa application.

After 6 months, or perhaps now if, under Cat B, you have in the last 12 months actually earned the Financial Requirement.

In the last 12 months how much have you actually earned Gross?

From January to October my gross pay was £1250. Which equals to 1250*10= £12,500 an at that time I had savings less than £16,00. November and December gross pay was 1560*2= 3120 so total for that year was £15,620. Which falls under the financial requirement of £18,600. At the time I hadn't had enough savings either. So was unable to use any of the payslips. In order to submit an application for visa. Now I've got 3 payslips which equal to the financial requirement so will have to wait for 3 more before applying. Unless in march if they bring the financial requirement back down to 13,400. Which will still take a couple of months for the new law to be decided on.

How much have you actually earned from Feb 13 - Feb 14, gross?
