FLR Application eligibility criteria

Hey guys

I got married in Jan 2013. The same month my wife came as my student visa dependent. I will be applying for ILR this august as i will complete my 10 years. Is it completely OK if my wife applies for an FLR application at the same time?

i heard there is a requirement that marriage has to stay for 2 years at least in order to be considered for flr application. My 2 years of wedding will complete in Jan 2015 since i got married in Jan 2013

Please advise

Who told you that it's absolutely wrong .its better to apply with you and ask ho to wait till they decide your app. It's good for your wife to get flr as soon as possible so her time for ILR will start straight away .you can apply for further leave any time before the end of your valid leave ( any time ) . Your marriage is already proved that's why your wife is here on dependent visa you just have to change visa category according to main applicant otherwise she will remain dependent .hope this helps .

do i have to prove that i am earning to support my wifes application for flr? cant i just show the required funds incase if i am not working?

If you are student through out and as students are not allowed to work then you don't have to show any income thresholds .that's why I am saying it's better to send now.but if you get ILR and as your wife visa is expiring in 2016 .and if you apply for flr in 2016 then You have to show income threshold .

sorry i didnt provide full info before. Just to clarify

I came with my wife in UK as masters student in 2013 Jan. My wife has a dependent visa and both our visas are expiring on 18 nov 2014. However on 25th august 2014, i will be eligible to apply for ILR based on long residence since on that date i will complete my 10 years

please advise what should my wife do to stay in UK

You have to fill set(lr) for yourself and flr(m) for your wife and a covering letter to homeoffice you should request them to hold your wife case until they decide your application.for flr(m) requirement is address proof that you both are living together and English requirement a1 and whatever your earning is according to your visa type .thats it
