FLR (m) English Level

Hi,

I am seriously confused about the level of English that my wife has to demonstrate

She has entered the UK under dependant of Tier 1 (G) migrant in June 2012 and her visa is about to run out end of April.

As it has not been 2 years, I have to apply for FLR(m) visa. However what level of language test does she needs to take?

A1, B1, B2?

I am looking at some documents where it says A1 and now below website says B2 which is a high level I presume?

A1 for FLR(M).

Do you have ILR? If so, did you settle as a PBS applicant?

Hi Amber,

Yes I have settled as PBS applicant. I have read the forum and there are transitional arrangements, is this correct? For example what if my wife fails to pass the language test on time does this mean she will not be allowed to stay in the UK?

I look at the FLR (m) form and there is nothing about these arrangements.

If she extends as a PBS dep there is no English requirement.

When extending, how long they give the visa for under Tier 1 General dependant again?

3 years under paragraph 319D(a)(ii).

It may be that she can apply to extend as a PBS dep by post and vary to SET(O), if a decision isn't made by the time she qualifies for settlement. Settlement requires B1 English and LIUK.

My husband obtained ILR as a PBS migrant, and i am here on a Depeendent visa which is due to expire in June 2014. My confusion here is do i apply for FLR(M) or extend my dependent visa on PBS itself.

Hi Amber, thanks for the reply.

I first came to UK on Dec 2011 on a dependent visa during which time my husband was s till on his Tier 1 visa. I stayed for 4 months are returned back to India in April 2012 and subsequently my visa expired on Jun 2012.(i believe i dont have to make reference to this visa in my application form where there is the question 'When did you first enter UK' as it has already expired)

Then i applied for a new dependent visa from india on Feb 2013 and entered UK on April 2013.And in March 2013 my husband got his ILR.

I dont know why this FLR(M) and PBS dependent. Not sure if i can apply for FLR(M) and if i can then what is the benifit.

If you apply for FLR(M) then your settlement period will reset to a new 5 years. If you continue as a PBS dep you may be eligible to settle in 2018. FLR(M) has both an A1 English and Financial Requirement.
