Confirm my eligibility - ILR from Tier 1 General

Post by SVK2014 » Sun Mar 02, 2014 3:04 pm

Hi
I have been looking at other posts but want to know about my case whether it can be taken further and apply for ILR, instead of one more Tier 1 extention?

I came to UK first time in 17th May 2007, on Work Permit and went back to India on 31st August 2008.
After few months gap I came to UK on 21st November 2008. Got my visa extended, become Tier2 (ICT).
Later I got Tier1 General on 10th July 2009 (with validity upto 10th July 2012) and had to go back to India 30th April 2010.
I came back to UK on 11th November 2010. I got my Tier1 General extention from 10th July 2012 to 10th July 2014.
So my current visa is due for extn in July.

As you see in 2010 I got more than 180 days gap but I am planning to apply for ILR in June2014, so that I can split the gap.
Assume 20th June 2014 is my application date, so back 5 years will be as below, other gaps are due to holidays
20th June 2014 - 21st June 2013 --->> gap 17 days
20th June 2013 - 21st June 2012 --->> gap 31 days
20th June 2012 - 21st June 2011 --->> gap 20 days
20th June 2011 - 21st June 2010 --->> gap 157 days
20th June 2010 - 21st June 2009 --->> gap 90 days

can any one help me whether I am eligible for ILR?
if I am eligible do I need to provide employer letter for that gap in 2010? even after splitting?
also do I need to prove English language condition again? I got points for this 1st time Tier1 application and at extention.

Please help.
Thanks

Thanks for confirming, boosted my confidence but can you also confirm
do I need to provide employer letter for that gap in 2010? even after splitting?
also do I need to prove English language condition again? I got points for this 1st time Tier1 application and at extention.

Based on forum member experience letter isn't required for absences <=180. If you can get letter easily then go for it .Take print out of PBS for english language requirement . That is suffice.

Thanks again.
Are you saying absence evidence letter is not necessary if the gap is less than 180days after splitting/without splitting into those 12months continuous periods?
in the application it shows like each absence need an evidence, so I am worried.
do you think I should go by Solicitor?

i'm saying based on the experince of forum members . Many of them didn't have letter and they were not asked for the same.
The point is if you can't get it or having really difficulty in getting it then you can go without it . No one can give the guarntee that CW won't ask for it . Generally speaking they don't ask if absence is <=180.

if you are worried then get the letter.

Thanks dk2011.

As I can't get a letter, will have to go ahead without it.

I have been going through the SET(0) application to make it ready, in Section 6.1, should it be the 1st entry date I came in 2007 or the 1st entry in 5 years period my application based on?
