any work done outside of immigration rule will effect the application, I did some self employed work while on student visa , not involving my NI number ? ?

First question if you didn't pay tax or national insurance how would home office know you were self employed once?
Second if not then there is no point to get panic

4)Does it effect LR application?

Wonder if anyone has any recent success in applying set(m) directly at PEO rather than flr(m) and then set(m) for their spouse who has been here for at least 5 or more years (however has been on student dependant + psw dependant plus pbs dependant). I'm aware that our friend sswz is going to try PEO on 3 feb but if anyone else has succeeded recently or in past.... Please shed some light. As I have posted earlier I'm thinking of applying set(m) directly for my wife who has been here since 2005 in various dependant visa categories as stated above.

Your insight would be very much appreciated.

my case was slightly different but I also had the same doubt whether to apply for SET(m) directly or FLR(m) route. (my wife is here since Jan 2008) so I called up home office and the lady picked up the phone seems knowledgeable and responsive.
she mentioned those who are PBS dependent and wanted to apply for ILR must switch to FLR(m) first- and once granted we can apply for ILR (set-m) even the next day (considering my wife is here since 2008)

I understand where you are coming from, its really waste of time,money and resources to apply for Flr m and then Set m, but clearly approved set m applications (without Flr m) are a mistake from HO and in other words those who got ILR without Flr m are lucky.
I wouldnt try my luck because of numerous factors

Well , Student are not allowed to involve any sort of self employed business , so this is clearly written on Terms and Condition of student visa , however if you have not declare it to the HM revenue then obviously no buddy will know about it ....and it will effect your application or not ? i have no clue ....i think they never check this ...

Why you guys need covering letter? Just fill the form, attach documents and send it.

If you got right of appeal. You must had ten days to lodge these ten days are not classed as overstay but under 3cand 3d.what I suggest you show your papers to some other solicitor as well. I persume you will have to explain it in covering letter when you submit your application. Can you explain the whole scenario again with right of appeal. So it would be easy to understand.

My friend (applied 5th September 2013 )get ILR yesterday applied one day before.
But one of my friend applied 01 September still waiting.

Stop panicking for nothing, HO is too busy with other issues and huge backlogs to check if you have worked more than your allocated time on your student visa. Just relax and pray that your application will come back successful. STOP PANICKING pls.

Hello irfan,
To answer your questions, the refusal on your Tier 2 dated 14/02/2008 on your passport and for the fact that you sent your application on the same day it was expiring which is on 19/12/2007 might be considered to be illegal by HO.
According to HO policy you are meant to have submitted your renewal before 19/12/2007, logically if you sent out your renewal Tier 2 application on 19/12/2007, there is no way HO would have received it on the same day, so basically they must have received it say may be on the 20/12/2007 which is late application.
Your solicitor was right about your illegal days in the UK, however it is obvious from your statement that your Student Visa application was made on 23/01/2008 after your refusal letter and hopefully the removal notice.
Am just wondering why you have not applied for your 10 years ILR since you qualified on Oct 2013, CAN U EXPLAIN WHY??, however there is no harm in applying now for your 10 year ILR as you might just be lucky your application would be processed by a caseworker with a good heart who might just overlook your illegal days (GAP) in your immigration history.

Hello vm81,
some people have tried that on this forum and they have succeeded, you might want to give it a try there is no harm in trying, i can only advise you to fill both FLR(M) and SET(M) forms and go along to the PEO with them, just incase they insist that your dependant must first change to FLR(M) before SET(M).
