Hello vm81,
some people have tried that on this forum and they have succeeded, you might want to give it a try there is no harm in trying, i can only advise you to fill both FLR(M) and SET(M) forms and go along to the PEO with them, just incase they insist that your dependant must first change to FLR(M) before SET(M).

I never heard of anyone who got old brp, it must be new .

Hi Every one,

I have been on here for few day and I have already applied for ILR (LR). My question is my Mrs and I got married here in UK back in 2009 at that time we both were at PSW. Then in 2011 I got my TIer1 General and I got her as my dependent ( I have to go through the court as they refused her dependent visa saying she has to apply from home country but court allowed the appeal). Now since I m waiting for my ILR(LR) result and I hope I will get it Inshallah and once I get my ILR what will be my wife's status as she is in this country as my dependent for last 3 years alomst. Do I have to apply for the VIsa for her as dependent of a settled person. I hope I manage to convey my question hoping for some very helpful answers.

hi everybody finally after a long wait i got my ILR n not happy with the time takn in my case
but i wanted to share my timeline the way u guys did n helped me how things were going on about
ilr application so..

applied on 05/aug/2013
bio done 15/09/2013 or 17

To answer your questions, the refusal on your Tier 2 dated 14/02/2008 on your passport and for the fact that you sent your application on the same day it was expiring which is on 19/12/2007 might be considered to be illegal by HO.
According to HO policy you are meant to have submitted your renewal before 19/12/2007, logically if you sent out your renewal Tier 2 application on 19/12/2007, there is no way HO would have received it on the same day, so basically they must have received it say may be on the 20/12/2007 which is late application.
Your solicitor was right about your illegal days in the UK, however it is obvious from your statement that your Student Visa application was made on 23/01/2008 after your refusal letter and hopefully the removal notice.
Am just wondering why you have not applied for your 10 years ILR since you qualified on Oct 2013, CAN U EXPLAIN WHY??, however there is no harm in applying now for your 10 year ILR as you might just be lucky your application would be processed by a caseworker with a good heart who might just overlook your illegal days (GAP) in your immigration history.

Much appreciate your time. I did applied few days ago, but on my SAR file they received on same (Expiry) day ,Which sounds like its safe inshallah.

I was an false allegation during Aug - DEC 2013 and waited for case withdrawl, don't wanna select conviction bits. Thats the reason had to wait till today.

Can you PM,if you got any sample covering letter please? would be greatfull..

Congratulations matey! Your wait is finally over :)

If I am not mistaken, you were the last August applicant outstanding that means we have a 100% approval record for August 2013 applications on our skydrive, the first time since we began taking records!

Congrats, Old BRP would have been cancelled by the HO. It must be the new one.

What if home office send a letter asking for more documents but I dont receive that letter. So home office thinks I have received it n I think havent sent any such letter n then dont send documents they are asking for.

Your suggestions please

Finally I have received my passport with the approval lette today. I did miss the DX courier yesterday,which has been re-arranged to be delivered today. :D :D :D

hi..
i was on student up to 5th august 2013. And just before expiry my solicitor advise to apply for flro . i still had 2 acca exam to resit but he advised to file flro instead of student visa.
Visa was refused in beginning of October 2013. November 12 filed for appeal. on the 24th november 2013 i completed 10 years in uk. i have received hearing date for June 2014 based on fLRO app for private life. However i want to file for the 10 year ilr now.

is that possible as Im getting different views. many thanks

I got some response but i still bit confuse.

Does the appeal on FLRO application counts towards my 10 years legal stay?
Can I withdraw the appeal and submit 10 years application.

Please advise!

Hi guys,

I have been a silent reader on this very useful forum for a very long time now. I applied for the ILR on the 10 year long residence route on the 16th of Sept 2013.

5 Years Student Visa + 2 Years Work Permit + 1 Year Student Visa + 2 Years PSW. I have no gaps and have not been out of the country for more than 150 days in the last 10 years.

My timeline:
Applied: 16 Sept 2013 [Payment Method: Postal Order]
Acknowledgement Letter: 19 Sept 2013
Biometrics Letter Received: 10 Oct 2013
Biometrics Enrolled: 10 Oct 2013 (Same Day)
Approval: Waiting
Biometric Card: Waiting

Documents Submitted: Passports + Biometric Card + Original degrees + Employer Letters + Life in the UK Test Certificate + Utility Bills + Letting Agreements etc

Please update the skydrive with my details. I am hoping to receive my approval letter soon as some of the September applicants have started to receive their documents back. I did call the Home Office this week to enquire about my application, they have confirmed that it has NOT yet been assigned to a case worker yet :( .

If any Gurus can answer, how many days does it roughly take once its assigned to a case worker? Thanks and Good Luck to All.

I have missed the delivery today as well and rearranged it for next week..i'm also confused as i have not received any letter and normally they send the brp/passport by courier if they refuse..

finger cross...i hope its all going to be fine...

HELLO IRFAN,
I HAD PROVIDED NO DOCUMENTS AT ALL NOT EVEN COVERING LETTER.
I HAD SUBMITTED ONLY APPLICATION FORM, MY PASSPORTS (2 OF THEM),LIFE IN THE UK PASS CERTIFICATE AND THAT IS ALL.
I BELIEVE AS LONG AS ONE CAN SHOW THEM THAT HE/SHE HAS LIVED IN THE UK FOR 10 YEARS LAWFULLY ,THEN THEY DO NOT HAVE ANY PROBLEM IN GIVING THE ILR.

LET ME HOW IT GOES
