Re: Application for PR or PR card: form EEA (PR) - UpToDate

Post by Ewelina » Sun Mar 20, 2016 10:32 am

Hello All,

I hope someone will be able to help me.
My question relates to Permanent Residency certificate which I would like to apply for.
I've been living in the UK for almost 9 years now. I originally came from Poland and purpose of my visit was to improve my English in order to be accepted to the University in Oxofrd. My first years 2007-2008 I spent working full time & attending English school in the evenings. In 2008 I was accepted into University & I started studying 4-year course 2009-2013. For the whole time of my studies I was working part time in order to be able to fund my studies as I didn't want to claim any benefits- that was not why I came here in the first place.
I also had a student loan which I'm still slowly paying back now.
After I finished Uni I went to work & build my career straight away and I can honestly say that I'm really happy where I'm now.

When I started filling in my PR application I've noticed the question about Health Insurance for students. I applied for my EHIC card straight after I got accepted into University & it was valid 2008-2013, so for the whole duration of my studies. On the PR application form it says that EHIC card should not be issued in the UK but my home country. As you can imagine back then my English was not very good & I really believed that I'm doing the right thing ordering UK EHIC card as I worked in this country. Yesterday I read a few forums and I saw people saying that their applications were rejected due to lack of support for required insurance cover. I really don't know what to do know.... Any ideas?

The other issue I have is the fact that I have to write down all the absences from the UK during my 9 years here. I do remember the last 5 years but going back the next 4 is very hard. I did travel a lot, every 3 months to my home country for a week. As they were just a family visits I didn't take many pictures- so I can't even estimates dates from any old photos. I do remember that I've always used my whole holiday allowance each year but not more than that. Is there a way of contacting an airport to check my dates of absence - e.g. when I entered the UK etc.? How did answer that question?

I would appreciate any help with this
Thank you & have a lovely weekend all!
Ewelina

Can some one advice about the requesting passports back link??
I had the confirmation e-mail back on 18/2/2016, Is it ok to request the passports now or is it better to wait ??its already 49 days since the application was sent??will it affect the application ,and what is a better reason for the request to put on the form??
One more question:I applied for the whole family(5 members) on the same form, maybe that's why it takes longer than others to get the Decision??
Thx for your advice

Hi ,
I applied 05 Nov. as Non EEA- retained right of residence. I am not expecting to hear from them for at the moment, but only after 5 months, I would probably start getting anxious as that is the minimum time most Non-EEA guys have heard from HO.

Good luck!

You are in the average.
I got my payment after 4 days, you got it after 6 days (maybe bank time?)
I got my email after 18 days, you got it after 16 days.

I think the average is 7 to 10 weeks. I expect mine towards the end of April.
You may get it after mid April.

I have just registered.

On and off, over the course of 8 years I have used this website a lot. Now it is time to give back to community. Just as most of you, when it came to apply for a British citizenship, then, I realised I need to get PR card.

Hence, I applied for "document certifying permanent residence" on 17 January 2016.

I am a Bulgarian citizen.

Here is summary of my timeline:

Application sent: 17/01/2016
Arrived on (signed for delivery) : 18/01/2016
Money taken: 20/01/2016
Confirmation of acceptance (email): 01/02/2016

as of today it has been 43 days, and counting.

Good luck to those who are still waiting for their application results.

Hello All,

Here is an update, (as of 4 march 2016) I have received my "Document Certifying Permanent Residence". (See the detailed timeline above in quotes).

It has been 46 days since i sent documents and received them back. Minus 2 days, it is 44 day. (date on the document says its issued on 2nd March 2016).

Full disclosure; I was hoping to receive a driving Licence sort of card (based on what I read from this forum). But that was my misinterpretation. Now I realised that they send you upgraded version of your latest residence/ILR/registration Certificate, with your new picture on it.

Bulgarian and Romanians expect to receive same sort of Blue Registration Certificate with a new picture on it and in the type of document section it will say; type of document: "Document Certifying Permanent Residence". Which is what they ask for in British Citizenship Application form.

Now I am a resident since Feb 2008, the biggest question is, should I apply for British Citizenship, or do I have to wait another 12 month? Can anyone answer that for me please?

I think this is the gray(est) area and thousands of people in the same situation, puzzled and don`t know what to do.

Just because "Document Certifying Permanent Residence" says its issued on 2nd March 2016, does not mean I was only resident for previous 5 years to that date.

if the rule has not been changed in British Citizenship Application in end of 2015, I was not going to apply to permanent residence card (in fact they were advising that this was optional, if you feel like you could apply for it, but if you dont bother you did not have to).

I strongly believe that, this 12 month waiting time for British Citizenship application after obtaining permanent residence document, is not applicable for those EU citizens who has been resident in the UK for way longer than residency qualifying period.

Oct 2015 rule change really put all EU citizens in an awkward position, for whom were already considering to apply for British Citizenship.

What are your thoughts on this? Can anyone enlighten us on this?

Many Thanks

Hi,
Most people start receiving only after 5 months and a week. I would start getting anxious only after that. You are not even months over. Good luck ;)

Hi Ciaocico,

he wrote it in the message. He received the 2nd of March. 46 days. Almost 7 weeks.

I submitted it the 24th of April and it will be 50 days the 14th of April.
I will start to wait for it by that time...

use this to play with the dates http://www.timeanddate.com/date/dateadd.html

Hi All,
I have been searching through the blogs for specific answers on EEA PR requirements. I need your help to help me sort two main queries with regard to immigration stamps and comprehensive sickness insurance please.

My Case:

My wife:
Polish National
Student at Scottish university, completing course in two months
Will seek employment following graduation
Currently is not on a private health insurance (CSI)

Me:
Indian National
Interning at a company
Seeking full time opportunity in UK. Expecting to secure a permanent employment contract asap.
Private health insurance expires this month.

Dilemma - Weekend trip to Netherlands - immigration officer put a inward stamp on passport but did not put a stamp while exit. Would this create problems to confirm 'continues residence in UK'

Key Queries
1. Understand the document evidence requirements for permanent residence permit application. Particularly 'continues residence in UK' and CSI. (my wife is a student with no CSI)
2. Received EEA residence permit last year when is the earliest time to apply for permanent residence permits
3. Any 'life in UK' or similar test to be taken (both of us will be graduates from UK universities)
Do need to have details of all travel records until the application. Even for short trips outside the country.

Hey,

I was just wondering about when the original documents are returned.

I will be going on a week long trip to Montenegro in May, so I will obviously need my passport then. If I send off my application within the next week or two, can I be sure that I will have it back in time for my trip?

Thanks,

Iga

Hi there,

Great forum, hope it's OK to ask my question here. I'm about to make a PR application as an EU national (Brexit fears and all that lol), and I'm wondering if what I have for supporting documents etc are good enough.

My case should be quite simple (hopefully...), because shortly after my arrival I have started working for my employer, registered for WRS etc, and it's where I've been since, no change of work, no change of address. But... there come my questions:

1. I have lost one of my P60 forms. Luckily my employer gave me another copy, but it has "duplicate" written on it with massive block capitals lol, so I wonder if that's accepted, or should I ask for something else as well from HMRC or something?

2. Some of my later P60s are "substitutes" too, I guess this means that they are done online now and they are printed, so is that going to be acceptable, or again, should I include something else with them just in case?

3. For one year, I don't seem to have any wage slips, is that OK to replace them with stamped bank statements?

4. I'm on quite a low income (working part-time) and I don't pay any bills (my partner does, who was the reason of the whole moving thing lol), is that going to be a problem? I have NHS and DVLA correspondence for most years I think, but they won't look at whethere I'm "self-sufficient", will they?

5. The leaves section of the form - do I really have to list all holidays I've left the UK for? I have only left for a week's period maximum since I moved here, but they have been quite frequent, do I have to fill these in? I can only remember last year's lol.

6. If for any reason my application will be rejected, I won't have to leave, will I? I've started studying too whilst working... if it gets rejected, I will still be able to continue and remain at my workplace, and with my partner, right?

7. How long do you think it's going to take? I want to have my card before the referendum lol.

Maybe I'm worrying too much lol but any reply would be much appreciated from you guys, thanks a lot! I might return with more questions, I haven't started filling in the form yet, I just had a rough look at the 85 pages and started gathering the documents.

Thanks a lot.

Maybe I'm worrying too much lol but any reply would be much appreciated from you guys, thanks a lot! I might return with more questions, I haven't started filling in the form yet, I just had a rough look at the 85 pages and started gathering the documents.

Thanks a lot.
Welcome :)

PR itself is an automatic thing; all you are doing is applying for a document which confirms you have it. The document won't give you any extra rights, and is only really useful if you are aiming to apply for British citizenship (as it is now required for such applications).

1. Shouldn't be a problem.

2. Get your HR manager to stamp / sign them if possible. They can also give you a letter on company headed paper confirming the dates you have been employed there.

3. Sure, it's probably best to put in bank statements from all 5 years (just a month's worth from each year).

4. You cannot be working and self sufficient at the same time. Do you have anything else in your name? Mobile phone contract etc?

5. Only need to list absences from the start of your qualifying period until present, not from the date you first entered the UK, no matter what the form or guidance says.

6. Either you have PR or you don't, it's binary and there is no middle ground. You are entitled to residence documentation under the EEA regulations and HO can't reject you just because they feel like it. That said, you need to submit solid evidence to prove that you have indeed acquired PR. Your right to work or live with your partner will absolutely not be affected by the outcome of this application. Nobody knows what will happen after the referendum but it's extremely unlikely that you will just be kicked out.

7. Applications for EEA nationals seem to be taking 6-8 weeks at the moment.
