Hello Everyone,

I need clarifications on few things and maybe it will help others.

I have three children who have just joined me in Feb. 2014 after nine years absence from the UK, but they were all born overseas. I have been recently granted ILR on long stay plus my wife has been with me since Nov 2003, so she has also applied for ILR under the long stay in Jan 2014.

These are my questions

1) Will our children be affected by this new change on the 6th April for PBS dependants? If not

2) Can they still apply using form set(f) if my wife is granted ILR?

3) Will they be affected by the 2 or 5 years residence rule once my
wife is granted her ILR?

Thanks for your help SSWSZ .You been very kind. On your advise I am trying to find out information about verying application but don't understand that. There will be 30 days short for my wife if she applies for her ilr on the basis of her own long residency basis (that's after 28 days ). What can she do to reach that point. We were planning to submit our applications together ilr for me and dependent for my wife. We did not know what is going to happen. Been unlucky but anyhow there should be other ways as well. Kindly guide me plz.

I have been an avid reader of this forum since I applied for ILR in January, 2014. I only discovered this site after my application but it was a great source of strength to read about the various people who shared my situation. I am pleased to now add my case to the line of successful applicants for your reference.

Hi it says that Appendix A amendment was wrongly stated to come in affect from 5th of May 2014 by Home Office but all the changes are applying from 6th of April 2014 they are correcting that error that's what i understand from ur link

you can send application on Saturday but be aware some of post offices close by 12:30.SO if possible try to send by tomorrow

Hello Dear,

I am seriously confused now.
MY wife came to UK in 2004 and then went back to Pakistan in 2008 and again came back to UK in 2009. Since then she is in UK. My ILR on long residency is under process in Home office.
Is she come under the rule of or before 09 July 2012 ? In other way what is the best way to proceed with her visa. Right now she is Tier 1 General Migrant Dependent and visa expire on Feb 2015.
Please help me out. She did not give Life in the UK and English language test.

Hello fusow1965,
your children will need to apply for further leave to remain using form FLR(M) and i believe from my understanding of your statement above that they would be affected by the new rule if they are currently on your previous visa before your 10yrs grant of ILR otherwise if they already depend on you based on form FLR(M), then they won't be affected. But the moderators will throw more light on your issue/query.

no this rejectionwill not affect yoru ILR, mainly because all your applications were in time including your 2nd PSW, you never applied out of time(when you did not have visa). you can request SAR to check all your applications were done in time.. but sounds like they have been.

Hi HowILR,
that would be great if you can share your good news with the rest of the forum members. The advice i have for your wife is if you can book online for PEO that would be great but it appears its late already for you to do PEO, otherwise you should fill out form FLR(M) and send it by post before 6th or by 5th of April.

Hiall,
You need to apply FLR(M) for both your daughter and wife. You daughter was born in Pakistan so she can't apply naturalisation straight away. Both of them have to convert their status to dependent of a settled person first through FlR(M). And mind it that there is a rule change coming on the 06th of April 2014 after which they have to spend 5 years as dependent of a settled person to qualify for ILR. Only if you can apply for them before 06th April will save you from the Idiot spammer. All the best mate.

Congratulations, Looks like Home Office is speeding up the cases. It use to be like 6 months process.
