In my case home office replied that as i already lodge my appeal so they will not review it.

In these days MP are not really willing to do anything as I've requested my MP several times but he does ignore my every request.I guess who got their refusal overturned its all about luck and the will of Allah .

Review and appeal is one process
First it goes for a review (15 weeks) if successful then u would know in the first 6/7 weeks
If not then it goes to appeal (court) this can take up to a year

Could u please tell me as you have mentioned in ur very first post that ur mp wrote to TRIBUNAL and now u r saying that he wrote directly to Home Office .
Did he wrote another letter to Home Office and previous one was for tribunal which replied it would take 6 to 8 months??

I just emailed that Sheffield Islamabad email asking them about any updates and they said that they haven't started my review still, my review deadline is in a week.

Do you guys know if there is anything I can do, would it go to a hearing if the ECM doesn't review my case by the deadline provided?

The review deadline is just a date they hope to review your case within, it is not set in stone. Chances are that the case will now end up in court. From what my solicitor said the HO does not have the resources to review every case. It's a sad state of affairs.

How can they not have the resources when we pay so much in fees!

I researched around a little and I've found that if an ECM doesn't review your case by the deadline then it will be listed for court but the ECM can still overturn his decision and issue visa up until the day of the hearing.

So I'm hoping and making dua that he reviews it and makes a decision soon, In Sha Allah

Its not true, you could hear upto last day of your review deadline, Mine came positive 2 days before my review deadline.

And yes I hired a solicitor to represent me and they wrote everything

@stillwaiting is said truly based our last year review experience but after xmas every review goes delay so keep faith on Allah they are reviewing ask them u still have chance even the last day of court hearing unless they wont review it yet. So hope for the outcome to be positive.

I've been at this immigration thing for almost 2 years now and 99% of cases dont even win review and if they do then its way early in the deadline. In my experience i havent met or spoke to one person yet who has got it 7 weeks + or before court. U do hear about one off cases getting the visa at the end or just before court but thats what itis "one off"

Im not trying to make anyone feel down but there is no point having so much hope only to be let down, it hurts more

@MGH BHC reviewed it urs as well thats the result u had ur appeal bundle .They reviewed it your within ur deadline and kept it upheld.So,in my experience BHC now reviews each application some late some quickly but try to make outcome within deadline.All who didnt listen any news from bhc and they have crossed their deadline should ask BHC that their decision are upheld to make it confirm that they are going to court.

In 2016 , we have two sisters in this same forum who got overturned after 7+weeks .and two my friends got as well so hope is still here infact bhc itself replies that because of xmas we have long queue so please wait for a bit longer to get it done.@anxiouslywaiting ,@dcfintness got goodnews .my heartiest congratulations to u both.May u have a prosperous life with ur spouses.:)

Hey

Up date on my appeal hearing which was today.

Had a really good appeal - not many questions asked, judge and home office solicitor was satisfied with a financial requirement on my behalf. So no further questions asked for that.

My hubby was a overstayer on his student visa so when the eco refused our application on this basis 320 (11) - which means that he aggravated immigration rules.
Apart from being a overstayer he had no other aggravated factors, but the home office solicitor believed as his college fees were not paid this was.
The home office solicitor told the judge he didn't have any evidence as the home office building was flooded at xmas so majority of files were destroyed so he is unable to back this with anything - home office asked me questions about this and i advised I wasn't sure if fees were owing as this would of been owed before he met me.

That was all it was quite straightforward and I think I will get a positive response.
