In simple words every dependent of long residence will be under new rules means showing income threshold plus 5 years wait for ILR who applies for dependent visa of settled person after 6 April .if you read. Last 10 to 15 pages you will get clear pic of rules

I am seriously confused now.
MY wife came to UK in 2004 and then went back to Pakistan in 2008 and again came back to UK in 2009. Since then she is in UK. My ILR on long residency is under process in Home office.
Is she come under the rule of or before 09 July 2012 ? In other way what is the best way to proceed with her visa. Right now she is Tier 1 General Migrant Dependent and visa expire on Feb 2015.
Please help me out. She did not give Life in the UK and English language test.

Thanks

Hello Faisal,
If her last entry to UK as dependent is in 2009, than there is every likelihood that she extended her stay here as a PBS dependent before 09th July 2012, which means that she was covered by the old rules and that she didn't needed to show any income threshold from you, the only thing she needed was to show that she can adequately maintain her self. The other advantage to her is that she is eligible for her ILR straight after she gets her FLR(M) as she has already spend her qualifying time. But all these rules are for any one who applies there FLR(M) before the 06th of April 2014, which leaves you with just today and tomorrow to apply, otherwise she will lose on every thing and than once you get your ILR she has to apply for her FLR(M) and start the qualifying time again and mind it that qualifying time is 5 years, that is the time after which she could apply her ILR. But you have another issue as well and that is she hasn't got Life in UK and English language test, which frankly you can't sort out in this time, so I am afraid that you guys have lost on that, unless there is away that you can apply and send the rest of the documents for later ??? Which I am not too sure about. Gurus and senior members please provide your feedback on this, as time is of essence on this. Many thanks.
Kind regards
Shah

Can someone please reply:

On FLR(M) who needs to sign page 46? Not sure if it's the partner or leave blank.

Leave it blank it's from third part except you who is giving you any financial supports like your parents or friends.

I'll be posting my wife's FLR(M) in next couple of hours. Still confused about the question 2.2 as she is currently PBS dependant and applying for first time as partner of a settled person.

Also what we put here will it have any impact on her combining the PBS and FLR(M) leave?

Hi Malik,
Good question, as I never even thought about this, if it will have an impact on the PBS and FLR(M) leave ?
I just ticked yes and continued to section 3. Frankly I don't think it will matter a lot in our case as we are applying for the first time on this application. Please Gurus and senior members some guidance is required. Thanks.

Hi mhjohn,
I have started as: I have applied for ILR 10 yrs, can i know the status of my application.

And then I have asked do you have any definitive date when they have sent my application to the Case Worker Dept, the outcome was they dont have any date available on their system of when my application was sent to CW Team.

Can you also Update Once you are done with your call.

Thanks in Advance......

I've now applied for my wife's FLR(M). Thank you all for your help and support.

Not sure if HO is open for deliveries tomorrow but as long as we send it before 6th April this should be okay?

I'd like to mention that I've applied with Trinity College examination report but have mentioned that we will forward the certificate ASAP.

I think the fact that she had passed before the application day should be sufficient. And also, I don't expect them to start looking at her application for another 3 months as I just applied for mine.

If anyone else is in the same situation re English test please keep in touch.

Next thing I want to ask is how to notify HO of change of address? I'll be moving to our new house in a few weeks time and have already mentioned that in my wife's form.

Regards
Malik
