Also if they have taken your fees according to old rules they should consider it on old rules

Wife SET(M) visa application and claiming Public Funds

Dear All, I recently got my ILR on the basis of 10 years long residency and now I am going to apply my wife SET(M) visa as she came here in April 2008 as my dependent.

My wife salary is 26K plus per annum and I just started my own business and my income is zero at this moment. After getting my ILR, I started claiming public funds and currently I am getting child benefit, Housing benefit and child and working tax credits. All these benefits are on my name and coming into my bank account.In SET(M) form, I have to declare all these public funds.

is claiming these public funds have any adverse effect on my wife's SET(M) application? please share your experiences and put some light on this.

Hi Ali,
First thing first is that after your ILR on 10 years long residency, you have to first apply for FLR(M) for any dependents to convert their status to that of dependents of a settled person. Before 06th April 2014, you could have applied a straight ILR on SET(M) but no more, If you look into the forum closer to those dates you will find a lot of information regards to that.
Regards to you claiming benefits, yes that will have an adverse effect on your dependents applications. Although your wife earning 26k might help, but ideal scenario is if you are not claiming benefits.

Please clarified few question for me please,I recently apply for IlR 10 years route(8.5 years student and 1.5 year PSW) and waiting for result and that was 05/02/2014 application .
1- My wife is currently a dependant on my PSW visa (30 June 2012-30 June 2014) and has been on dependant visa of tier 4 student sept 2007-June 2012 before ,when HO granted her a dependant visa as my wife (this is when I apply for a visa here and I include her passport and marriage certificate and she got the visa and then join me here ). Now she has to switch to a spouse visa of a person present and settled in the UK once I get my ILR ? This will be done on form FLR(M).
My first question is Once she gets her spouse visa, can she immediately apply for settlement as my spouse on SET(M) as she has been in the UK for more than 7 years as my dependant (spouse)?
2-Second question is regarding our 2 kids born in Uk do I have to apply for their register on MN1 individually or it can still be done like before on 2 join application with reduce HO fees ? And in this case what will be the fees please
3- I have noticed my biometric invitation was issue from Liverpool capital buildings vein that I live in London ,is it mean application take more time to be decide opposite to some case considered from Croydon office ?

I have one question in my mind.
I applied on 11th feb.
But my biometric was received on 13th and I recorded on the same day.
Now the question is my application consideration by case worker will be according to application submission date or bio metric recorded date????

Applications are decided by the date of application not date of enrolment of biometric details.
I applied a day earlier than you on the 10th of February, and recorded my biometrics on the 5th of March. Let's see your and my timeline will be the one to decide is it the date of application or the enrolment of biometric :D

Answer to question 1 is, yes your wife can apply a SET(M) application straight after getting her FLR(m), as she is PBS dependent prior to 12 July 2012, and still covered by the transitional arrangements under part 8 of immigration rules.
Regards to question 2, I am really sorry not sure about that, so I won't suggest any thing.
Regards to question 3, no that doesn't have any effect on the timeline of your application. Every one send their applications to the same address, and the biometric are send through from the same place, so you will be following the same time line as any one else.
Looking at your timeline, fingers crossed you should probably get the good news in the coming week or so.

Bio enrolled 06/03/14


I spent last 18 months on 3c, 3d. my appeal was rejected by Upper tribunal and had the right to challenge it further in COA but since I completed 10 years at the same time, I applied ILR instead. I applied 12 days after the decision of UT. I think it wont be problem since I have the further right of appeal or 28 days to apply afresh in any category.

Hi I do not think you can apply for ILR for your wife just after her FLR (M). I think she will have to wait till 5 years or apply when she is 10years on 2017 since she will be applying after 6th April 2014.
