i cnt believe it, its still hasnt sunk in...
altho he called from the BHC islamabad number but he introduced himself as the ECM looking at my case from abudhabi..

wot do u guys think, how long till i get this letter now??
Syma, you're one of the few people who has had direct contact with an ECO and a ECM now, in fact in all the time I've been reading and have been a member on immigration forums, you are the first, so we don't know from previous examples what this means.

But what will happen now is, he will email AIT and send your documents back to them. Within the next 2 weeks, maybe 3 weeks, you will get a call letter, this may be in the form of an actual letter or an email. So I would suggest you get your TB Test sorted out next week, so you can do straight in an submit your passport.

I will say again, if ECM says your decision will be overturned, then it will be, no one is that cruel to say it will be overturned and then not overturn. So Syma, expect a call letter by the end of August at the latest and hopefully a stamped passport before the end of September at the latest. Good luck, hope it works out well for you.
thank you for your wishes.

i actually recieved a cal from the BHC islamabad today and they asked for my email address in order to send me the call in letter. ive just recieved it:) booked an appointment for tb test as the previous one has expired, i'll submit my passport next thurs InshAllah.

hope it worls out for evryone as it has for me, these last 8 months have been too long. inshalah evryonez wait will be over soon for good:)

That's excellent news, the call letter has come through even quicker than expected, let's hope your VISA is stamped on your passport and returned to you very quickly as well. Yes you had a long a painful wait it's almost over now. You can start smiling now and keep smiling for a long time.

In terms of submitting it next Thursday, I wouldn't leave it a day long, get your TB test done quickly and submit on Mon/Tues if you can, don't give them any opportunities to delay any longer.

Syma, if you decision making post was Islamabad, why was a ECM in Abu Dhabi reviewing?

If I am correct Mandarin is past his ECM review date and he's been assigned a court date, seems like his ECM didn't even bother to review or if he did, didn't bother with the post review red tape, so Mandarin will probably go to court and get overturned because the UKBA won't show up and if they do, will make up an excuse such as they didn't receive any docs.

I was refused at Abu Dhabi, at the bottom of your Notice of Pending Appeal letter (was sent to my wife in Pakistan) it says sent to respondent in Abu Dhabi Embassy.

I wanted to submit passport asap too bt a tb test appointment is not available before wed 15th, bt I am not conplaining now:)

For those who are wondering, there many common reasons for refusal.

1. English language requirement/test certificates.
2. Empoyment status.
3. Lack of proof for communication.
4. Marriage not being registered.

Often, even though they refuse on the grounds above, it is the ECO who has made the incorrect decision, it is not the applicant who has made a mistake.

There are also individual cases of refusal for example Syma's who you can ask about yourself directly. But don't worry, everyone wins in the end, these money grabbing thieves who call themselves the UK Border Agency are a disgraceful organisation.

A friend of mine, who's brother appealed for hsi wife in March this year, has just had his decision overturned. They were given September as the deadline. They got a call to submit passport yesterday.

Syma,

Thanks, it will be our turn when it is our turn. I'll continue to wait in the meantime.

Your comment regarding number of application is staggering, that is a lot of applications and that too at one time during the day in one AC, multiply by 4, then by 5 for days in a week, then by 4 for the month and you're looking at potentially 24,000 applicants, even if it's half that figure that is a massive number of applications.

My wife received the email from the BHC/Embassy asking for her to bring in her passport TB test certificate etc etc. Guess they're about to, or perhaps already have overturned our original decision.

Immi4u,

What were the reasons for your refusal and how did you prepare your grounds for appeal. Did you do it yourself, or are you going to have legal representation if it goes to court?

Mine was refused on paragraph 281 (iii) subsisting marriage ....... I have not include any kind of communication with the original file except few photograph of our wedding but now send extra evidences of communication including email, Skype log, kik messanger conversation, text messages( while in Pakistan), international SMS exchanged, few greeting cards . It's about more than 100 pages conversational record . My appeal has been lodged via legal representative in uk.........
Hope these things will satisfy ECM ...... Thinks so
Cheers

Yes if you provide evidence of communication then it's regarding whether or not they believe the marriage is subsisting or not, in this case if you provide an overwhelmingly large amount of supportting documentation proving this you will win. Something as straightforward as this, you didn't even need a lawyer for, but as with everyone else here. If they look at your case before the deadline, they will withdraw their original decision and you will be granted a VISA, whether that happens or not remains to be seen.

Need a number or email address to book a TB test. I called Gerry's but they said the following number is the only one they have:

111 466 472

And it is perpetually busy!

Our passport is handed in, should get it back soon, I'd say another few days, so not long for us.

As for yours, the good news is that there's a massive increase recently of the number of ECM reviews that actually take place, before they often didn't happen.

4 current appeals for members on this site immi4u and all have had their appeal withdrawn by the ECM and all are handing in their passport or have already handed them in.
