Dear Experts,
my friend needs a help. my friend is in under 3d. his upper tribunal appeal hearing is on 15 october 2014 but he'll be 10 years in the uk on 26/10/2014. his solicitor said he can apply 28 days earlier of 26/10/14. but some solicitors say people who are under 3c or 3d they should apply after their arrival date, 28 days early application submission is not applicable for them.

plz suggest..any of your suggestion will be appreciable. many thanks.

Hi All,

My wife got her FLR (M) under old rules last week. She got visa for 2 years that means she can apply for SET (M) straight away as she is here since 2007. I was looking at SET (M) form and got bit confused if it the right form. It has following line

"If your last grant of leave was not issued under Paragraph 281, 284, 295A or 295D
under Part 8 of the Immigration Rules you MUST NOT apply using this form. If you
have not had leave under one of these categories and apply using this form you
will be refused indefinite leave to remain under the Immigration Rules."

Version 04/14

I suppose the visa that she got comes under the rules mentioned in above paragraph. Can some please advise if there is an other form that I should use to apply for SET (M).

quick quesiton -
my wife got 2.5 yrs of Visa on her FLR(M) applicaiton submitted in January - at time pending my decision.

does it mean she got it on new rule or old rule?

does she need to wait for SET(M) or can apply straight away?

i just called and they said that the processing of your application is not completed yet.
you need to wait.
for any thing, UK visa immigration service will post it to you.

im worried , are they doing any checks???

"Application not completed yet " doest it mean it is with the case worker or it is a standard reply for all pending application. earlier they used to say whenever I called , application is under process ???

That reply was unexpected by me.

Hello Sajjadali and khani,
Don't get paranoid guys, don't understand what is the difference between the two statements (Application not complete yet or Application still under process) one and the same thing. That is the standard reply that every one gets when they call. And if the Home Office want to do any inquiries than so what, we have a 10 years legitimate stay in this country and we are entitled to what we are asking for. And hopefully we will get it soon INSHALLAH, just a little bit delay in it, but we will get there soon. I know it is not easy to divert one's attention, as it is anxious time, but stay put, we don't need to panic, hope to hear the good news soon.

Hi Zaiby,
I am afraid that the answer is NO, as after the 06th April 2014, any dependants applying for an FLR(M) have to spend qualifying time of 5 years for their ILR.
If I am you, I would withdraw my LR application and apply with my dependants in March 2015, I know it is completely unfair for the Home Office to make such a drastic change knowing that it will effect honest people like you go through the agony and pain of waiting for another 5 years to get their life's on track.
I hope other senior members will comment to explain as well.
