Its true their law states that.U should refunded extra amount next day to follow their law and for a safer side to win at review stage.Even though ,you have bright chances to win .
But I had refunded it so in a way I'm following their rule as my payslip matches but ECO didnt even bother to calculate it and minus the extra refunded amount .
We gave alot money to just make us a refusal letter.
Anyway its my solicitor's fault too he said dont explain it , its clearly shown in ur bank statement .Aren't they blind.Now wha t i assume are they .

Applied for my daughters British passport in Pakistan and after nearly 6 months I have been called up for an interview in Birmingham. Does anyone have any information regarding the type of interview it would be and what type of questions they could ask.

U should have applied for right of abode takes 2 months

Is it best to reapply?
As my solicitor said that by reapplying
We will not be able to put our refusal points
Ahead to the court
I wanted to ask if possible, that if we reapply
Do we need to explain to BHC the refusal
Points in the first application
As if we reapply we will add all the missing
Paperwork BHC mentioned
Or just reapply and add the paperwork without
Mentioning the reasons of first refusal.
We are waiting for a review date, then take
Whatever possible action after

When applying 2nd time it said on the visa form have u been refused before if yea state why and gwf number

So we wrote the gwf number and wrote financial reason
1st App:10.06.14-Refused 21.11.14
2nd App:04.02.15-Refused 22.04.15

You must declare all previous applications and reasons for refusal. Failure to do so will almost certainly look bad

The reason for asking this is because they refunded me IHS fee when my case was refused. I got my decision overturned on 1st feb 2016 then I received the call in letter after 3 days but they did not ask for IHS fee. Gerrys had no idea either how they will take this payment. I submitted my passport yesterday along with tb test and call in letter. Please send me the email you received asking for IHS fee if you can. JazakAllah

congrats and alhamdolillah on getting your visa allowed. same situation with my mrs - appeal was allowed, call letter recieved and we submitted passport on 4th feb but haven't heard back yet....do you know the timescales (my wife didn;t bother asking!) of when we can expect them back?

Thanks and congrats to you too. Have you paid your IHS fee again before submitting the passport and call in letter? Did you receive any email asking to pay your IHS? I don't know because when I received the phone call from BHC Islamabad I did asked them and they said it will take 7-10 working days but looking at few people's timeline it took around 3 weeks and sometimes 23 or 25 days. I have not received any email yet asking for IHS. I enquired on UKVI through email but no response yet then I rang them on the number that charges you 1.37 pounds a minute and they told me that you can make the payment on visa4uk website from your old account but I am waiting for their email because they have asked @rosie.x and @raymandosnr to create a new account on visa4uk and make payment. Really realllyyyy confused.com atm dont know what to do at this stage. To wait for the email or make the payment myself :?[/quote]

Wait for the email, at least give them a week or two them go ahead and pay yourself, dont worry they never forget about taking money!

Payments can be made via any method, including cash deposits. Just make sure wage slips abs deposits match up and tax and NI are up to date

One more question. When employer sell the business and new employer forget to pass my p60 from old employer to his accountant and the accountant haven't taken my old income into consideration to deduct the right income tax on four payslips after I informed hmrc about the mistake they give me new tax code and the accountant corrected everything on next payslip and all owed income was taken from by employer and paid it.
Will mistake have any impact on my spouse visa application?
I called hmrc again they said I don't owe any income tax and all the have been paid.

As long as all wage slips add up and your income meets the financial requirement you should be fine, are you paid weekly?

Hers is my spouse visa timeline:
Applied 26oct2015
Refused 21st Jan
Appealed 5 February
Money taken12feb

We had used category D through cash savings. This cash came from a property sale. So we applied right away and did not waited until 6months because according to appendix-fmse 7.4.11 and our solicitor we can do that if cash is from property sale.
But we were refused because money was not kept in account for 6months prior to application.no other reasons in refusal letter.
I want to know if some one have this same kind refusals. And what are our chances for the decision being overturn...

Your solicitor is incompetent, the sale of the property shows the source of the cash. Cash savings need to be held solely in your account untouched for a minimum period of 6 months

Property sale was the source of ur saving.
But as far as I know Saving must kept in account for 6 month minimum prior to ur application.
In cash saving u have to meet two requirement.
To show the credible source of that saving.
Another 6 months kept in account.
Hope this helps or other will guide u more accurately.

But according to appendix fmse it also say:
7.4.11. This means that, where the cash savings held at the date of application are the proceeds of an applicable property sale; the period the property was owned in the 6 months prior to the date of application, before it was sold to produce cash savings, can be counted towards the 6 month period. So money held as cash savings at the date of application can have resulted from the sale of a property for the first part of the period of 6 months prior to the date of application and as cash savings for the rest of that 6 month period if the decision-maker is satisfied that all the requirements in paragraph 7.4.10......

Because At another forum I ask the same question and I have been guided that it a totally wrong decision and not by the rules so appealing is right and it will be overturned.

I have just read the rules, the property must have been owned by you or your partner, did you provide proof that it was owned by you?

You have 2 options, reapply when you have had the savings in the bank for 6 months or appeal with strong grounds, your appeal should succeed at review stage.
