can you add your timeline to your signature.

The process of checking employment details is different for each applicant, some receive call from UKBA, others have reported that they didn't.

I think your friend is maybe scaring you a little too much, as delays are preceived, as you don't know what the time line should be, so how can it be delayed, do you see what I mean.

What I do know is the ECOs will take as long as they want / need to check all details/documents provided in the application, the more documents supplied, then longer the process to check each and every detail.

This is for the benefit of the applicant, as the ECO will have a better/complete picture of the relationship.

I pray that your application is processed and a visa is granted.

My sis in law took City & Guilds International ESOL (IESOL) Diploma test at NVQC in Dina but it took ages for her results to come and just recently she received her certificate. She took the extra modules of reading and writing in case there was a change in the rules.

I would probably have told her to take the TOEIC test as it seems easier and would have been a lot quicker.

In regards to the employment letter, does it require information such as the time frame of the contract (currently only 3 months with possibility of being extended)?

Has your sis in law submitted her documents for visa yet?

The employment letter I am not sure about that because I have a permanent job it stated I am an employee employed full time and how much I earn weekly etc...

Is your brother on a 3month contarct @ his workplace? Im only thinking that if it was not extended and UKBA ring up to find out if he still employed there might raise a few questions...

just based on logic: the ECO would want to know that there is strong prospect of employment. if on a three month contract, i would show evidence that there is the option of extension and maybe also attach CV if it is strong to show that you should not have a problem finding employment.

Not yet Nazia, as my brother is compiling the documents at the moment, housing report etc.

It's a 3 month contract with a possibility of being extended which is likely to be done but the employment letter that he got from work actually states the time frame. We're just thinking it's best to get that changed so it's not included on the letter (just in case it causes issues for the ECO).

Alongside this he will be sending his cv which shows his past history of employment and wage slips from his previous employment.

InshAllah all goes well when we finally submit her case =)

a tough and hard week has finally arrived.

I been so unlucky in various things, but since i got married, i feel i am the luckiest person, this wait is just for a short time, once its over, it will be just like a water bubble, having no value for all that stress people are taking and making for others, several fellows passed their words each day when they join this forum, for a new person who never been through such informative forum its quite difficult to find out what they are looking forward for...so being honest help them out at your best and ALLAH knows the best behind every single deed again.

Salam Brothers & Sisters,

I have a small confusion and I need your guidence. I am currently on ILR and recently married. I am in the proess of preparing documents for my wife. First if all I want to know the that what is the requirment of maintenance funds for spouse visa application? Have a look on the following link that makes me confuse

I am not an expert but I found this extract at another site, it may help.
£105.95 is the amount that a UK couple on income support receives from the government after paying rent and council tax, but before paying any other bills.
This is the minimum value that the UK government believes that a couple can live on and is the amount used for visa maintenance calculations.

Here at UK-Y we have been advising people that this amount is after rent and council tax, but before any other bills, for several years now (although the actual amount increases slightly in April every year) and the majority of people here who have applied using this amount (before bills) have successfully received their visas with no problems at all.

The small minority who didn't get their visas were refused because a) they didn't meet this minimum requirement before utilities, b) they didn't meet the other visa requirements or c) they included the wrong/not enough documentation.

I have yet to see anyone be refused for only having £105.95 after rent and council tax but not after utilities as well.

AOA Waqas Shah,

can you elaborate what your confusion is, the link you gave is to the standard guidance from UKBA explaining that you should have enough funds so that you will not have any recourse to public funds.

It is quite self explanatory , sponsor has to have enough funds to live together, sponsor wage must cover your Rent/ Mortgage & Council Tax and still be above £111.45 per week.
Also any savings you have will count towards this, I think it is 1/26 of savings added to the weekly total.

Please remember this is only until June 2012, then the rules will change to £25,700 income per year for the sponsor, and no savings will be counted, also no third party support.

I hope this explains the fund requirements.

AOA Gregarious,

the UKBA has a formula to guide them to see if a sponsor has sufficient funds so that they can show they will not have any recourse to public funds ( any benefits).

The sponsors wage is calculated to a weekly amount and then housing costs (Mortgage / Rent + Council Tax) are deducted , to this amount is added 1/26th of your savings ( i.e. 6 months).
This is the amount of time the UKBA feels the applicant would need to find a job and get financially secure, therefore the savings would start to get used up.
The 2011/12 weekly amount is £263.82, (you could add 5% for current figure) after Housing costs.

Like I said this is to change as the Home Secretary has announced changes to the Immigration Rules to throttle applications for settlement from the Indian subcontinent primarily.
Other countries will be effected but I feel it is to mainly stem the flow from Pakistan/Bangladesh/India.

"Sunday Telegraph reports that a leaked letter from Home Secretary, Theresa May, to Deputy Prime Minister Nick Clegg says the coalition government intends to introduce new rules on family migration from June this year. The letter says the minimum maintenance requirement for a spouse or partner will be £25,700 a year before tax, and up to £62.600 for those with three children. Probationary period will be extended from 2 to 5 years, English requirement will be strengthened, and a higher burden of proof for genuine relationship will be demanded. It says nothing about ban on external sponsorship or if any savings are to be considered along with UK sponsor's income."

"The main proposals are broadly in line with the recommendations of the Migration Advisory Committee (MAC) published last November. We still wait to see if outside sponsorship or savings will be allowed."

The changes have been widely reported, do a google search and read the newspaper articles.

What connection the £25,700 salary and sham marriages and forced marriages, are I can't say.
I know that the average salary in Scotland /Northen England is nowhere near this amount and therefore means sponsors from these areas will not meet the proposed requirements.

Also these reuirements may effect ILR applications, we will need to wait and see what the changes will be.

I believe the Home Secretary has a lot of changes she wants to be implemented and they will be announced in the coming week or two.

There is speculation on how quickly the MAC report recommendations will be introduced, but there is little doubt that they will be pushed through.

I accept that skstar is right that the UKBA is primary source to go to, but when you read articles like

“There is an interesting interview with the Immigration Minister, Damian Green, in today's Times (it's not available online - subscription only). No great revelations, but he just confirms what we have suspected. Some relevant extracts:

* The coalition government has pledged to reduce immigration from 240,000 to tens of thousands by 2015. It's still an achievable goal.
* Bans on the right of appeal for visitor visas. Coming in June is the stipulation that only those visiting close family member will be allowed to appeal, and from 2014, nobody.
* Announcement 'shortly' of changes that will make it more difficult for people to claim the right to a family life.
* Determined to reduce the number of immigrants who can bring their families to live in Britain. A UK husband will have to prove a minimum income before being allowed to bring in their foreign bride.
* Tougher English language requirement to promote integration.
* Making it more difficult to bring in elderly relatives, to reduce demand on NHS and other services.
* British business must reduce dependency on foreign workers.”

So it seems certain that an announcement is imminent, maybe as early as in the next week or two.
