Hi

I know of two ppl who recently lodged appeal as in the last couple of months; the from Pak lodged appeal in feb and the deadline is 10th jult.
One from India lodged appeal in beginin of march and their deadline is 7th Aug.
I am expecting mine to be in september really:/

Syma.... you really think it's gonna be that long...... it seems to get longer and longer.Looks like in gonna have to take a trip to Pakistan now..

Zully
Zully I am just looking at what deadlines other ppl been given and preparin myself for the longer wait. Ait Rep said they have a back log and runing 4wks behind so delays are bound to happen:/
My wedding reception is in sep I was hoping to return with my husband but that seems unlikely now:(

Unlikely with the law about to change. More applicants will be coming through, put yourself in for a 4 month wait, anything other than that and you'll end up miserable like many other people on this forum.
i doubt the law will change in the next few months. there has been no announcement as of yet!!
You never know, but i think King is right There are new changes coming into effect

Syma.....

You never know they are deadlines you may just get a descision quickily even that they are a month behind...Trust it to be when we hand our application in.
I thought that the appeal courts were going to have more people working there so appeal times will come down. It seem to be very long or is that due to the family visit visa.. that soon they will not be giving all them the right of appeals

even if they are announced they normally come in to effect 21 days after the have been announced. so 12th june is highly unlikely for them to change.

Som1984. Its no point worrying ukba make changes always,Generally with spouse visa i do believe as long as everything is genuine the visa will be granted... even if it goes to appeal Im sure most people have won.

i aint stressing, if they do bring it in i suppose the amount of applications received by the UKBA will decrease therefore making the processing times quicker. in a previous report i read it said that it would reduce the applications by 60%. that is a huge decrease in applications

Because they are going to implement limitations on maintenance requirement i.e. £25700 . Good for those ppl whose income is more than that otherwise low level income will not be eligible to come to UK with their spouses.
After taking Advice; remember Everyone's application, and thus supporting documents, will be different depending on personal circumstances.

if you hadn't handed your case in it would have made it stronger as it shows you have regular contact. when did you get married if you dont mind me asking?

Advice

Post by fbutt09 » Wed May 30, 2012 1:51 pm

Hey guys,

Its been a while since I posted. Hope you are all well and hear the news you have been longing for asap. I need some advice please.

Background:
A relative of ours (female and British, by birth) was married in Pakistan, 2007. Her hubby is also Pakistani but living and working in GCC (UAE). They have a child together who is British. They both lived in the UAE for a few years before deciding to move to the UK permanently.

As it is, they are living apart now, primarily due to their child's education being UK based; i.e. they agreed that its better for the child to have UK education rather than British Schooling overseas. In a nutshell she is now living with her family in the UK and started working in the UK to get a spouse visa for the husband.

Questions:
1. She has a Nikkah Nama signed and stamped by the relevant authorities at the time of their wedding. With the recent Union Council ruling coming in for Nikkah Namas, would they need to get theirs registered before submitting the spouse visa application? Meaning they would have to fedex it to Pak and get someone to do the running around? Any thoughts on this please.

2. The husband lives and works in UAE, his family is also over there and he has minimal contact with Pakistan, do they submit the application to the UAE British Embassy/Gerrys equivalent over there or does he need to come back to Pakistan and submit the application? Again any thoughts please?

3. Would the husband also need to obtain the TB Test Certificate. Would it be applicable as he is based outside Pakistan although a Pakistani National? Thoughts?

Seemingly a straight forward case but slightly complicated based on husband living and working overseas outwith Pakistan.

Please can you provide your thoughts and experiences.

Many thanks.

Yes I'm serious. My wife got a letter from AIT today, I spoke to her and she read out to me, there's two portions, one to the appellant, one to the responder (ECM) I guess the same letter is sent to the ECM as well.

I think the reason why it was much quick for me, is that I did it all online, payment was accepted first time and the form completed there too. In fact I'm disappointed I didn't appeal a week earlier, I could have if I had known better.

Now that we've got the deadline, which is the 19 weeks that they mention, I hope they overturn it pretty swiftly.

I can't quite understand how we've been processed already, given that today AIT is dealing with appeals lodged on 27 April. I appealed online on May 3. Who knows....

They give you a covering letter after you complete the application, you print it off and send the documents with that cover letter at the front. I actually sent my docs about 2 weeks after I appeals, I think on 15/16 May. Since the letter my wife got was dated 23 May. They handled everything within a few days of receiving my docs.

Thats really good. Atleast it shows that doing things online works much quicker.
I had that payment issue. I just called them they asked me to send the proof of payment which they send you. So I have just sent the proof of payment with a few lines asking them to get my case moving so hopefully i will hear some thing soon..
