Re: what is the processing times for the DL form

Post by peshi2015 » Mon Mar 16, 2015 12:42 pm

Hi guys,
Today I received my biometric card granting me 3 further years to remain, expiring in 2018. I applied to extend my discretionary leave to remain in June 2014 and a month later they sent me a letter to get the biometrics. I heard nothing from them until the end of February this year asking for further documents to show I was still living with my mother. I had received my initial leave as a result of my mother, but when it came to renewal I was out of the country on a year abroad for my university so I had to apply alone when I came back. The HO asked why I had applied alone so had to send proof that I was still at my mother's address. I sent the paperwork on the 2nd of March and they received it on the 3rd of March. On the 13th of March they replied to my mother granting her and my sisters further leave. Today I received my response with the biometric card enclosed. So happy that the wait is over. This forum has been such a pillar of support for me. Thank you so much for your posts, I hope you all get the responses you are waiting for.

This is the reply from HO to someone asking about when he can apply for ILR based on Time spent on DLR.

Dear Sir/Madam,

Thank you for your email correspondence of 15 June.

I am sorry for the delay in replying to your email.

You have not stated why you were granted DLR, if it was because a
non-asylum application was refused and you were then given Discretionary
Leave and you made the application on or before 8 July 2012, you would
then be able to apply when you have completed 6 years.

You would use the SET (O) application form to apply for ILR.

The answer to Q.1 is that you can apply up to 28 days before completing
the qualifying period, so your application could be submitted from 30th
June 2016, as stated on page 3 under section 5 "WHEN TO APPLY" of the
SET (O) guidance form:

Form and Guidance can be found at:

https://www.gov.uk/government/publicatio...
uk-form-seto

The rest of your questions are not applicable as you can apply on 1st
July 2016.

I hope this is helpful.

Yours faithfully,

Hi all

I received a standard letter from h/o just saying we received your application on 3rd feb 2014 n this letter confirms that h/o received your application for further leave.

The next 2 paragraphs was just talking abt work and how your employer can check using the ECS.

The only sentence i am worried about is:
I am not able to tell you when your application for further leave will be considered..

I am confused why send me a letter thats the same as i received back in january last yr when i sent my application.
I was waiting for a letter informing me my application has been processed now i am stressed does it mean i will not receive my papers why write to me jus to say nothing.

Any one received the same letter please share

Hi africangirl,

Don't be worried! You will received the decision! eventually. The criteria for "active review" is not that "active" meaning that as long as you maintain your circumstances as similar to or the same as your original grant with no "serious" criminal offences then you will be grant the extension.

I believe it could be just a standard letter - ICD.1100 - to remind you that your app. is "in progress" or that we haven't forgotten about you...sometimes they're just a bit of lazy to dictate a proper letter...they need to send out something like letters at certain time to keep their customer service target.

I received a similar letter via my solicitor last year saying that we "couldn't tell you the timescale", then 3 months later we also received another letter but containing the phrase like...they would made a consideration within the next 12 months and then boom!...out of nowhere the decision came this year.

If this couldn't ease your mind & if your app. would be considered by OLCU then you could ring them on 0151 213 4288

Hope this helps, just don't worry. you should know the UKBA waiting game by now :)

Hi there,
Just wanna add from the Deewani's post...

1. 6 years qualifying periods: Yes, if the DLR was granted before 9 July 2012 in the formula 3 years + 3 years...they seems to include the time while we're waiting for the decision of the extension period if we applied before the original grant expired...(nice for me  as I waited in total of 18 months! hopefully I could apply in next 18 months!)

https://www.whatdotheyknow.com/request/ ... iod_for_dl

https://www.whatdotheyknow.com/request/ ... o_remain_2

2. the form wise. If you were granted by other reasons than asylum/HP...yes, you have to use the set [o] form which I am assuming you previously used FLR [O] for your extension with the fees attached. My solicitor told me people who used FLR [O] form tended to receive their extension quicker than asylum route.

However, like my case & other friends here, we were granted DLR before 2012 because of refusal of asylum claim. I used DL/HP form (which now DL form https://www.gov.uk/government/uploads/s ... _04-14.pdf, see on the first page), we have to use the same DL form for ILR with no fees attached, but God knows how long for the decision for the ILR. That why I try to live my life & ignore this stupid waiting game.

You can find further info on UKBA's APPU Guidance under Transitional Arrangements
https://www.gov.uk/government/uploads/s ... uto,51,787

Hope these clarify things for us.

xx

@africangirl, I got the decision, biometrics taken, just waiting for the card.

@odat, no! mine is 18 months [sept 2013] in total from the date of submitting the extension till the decision received, not including the date of the card received which I am still waiting!

OLCU 16 FSU sucks!!!

Hi ArtMag

Was it the letter saying something like to send them within working 10 days, FAO to a named caseworker?
If it is, it's similar to mine. They try to make final decision before granting you the extension. it won't be long now, I hope.

In a nutshell, it's better to provide them with the info/doc they requested, I can't really tell much in details as it depends on case-to-case, what ground that you were originally granted your leave, like the up-to-date plus the rest of utility bills during the last year to show you're still living together as in spouse's cases, the recent photos, recent letters from friends - that sort of things or the recent letters from school to show that you're the main carer for you child, etc.

It is better to send the evidence that similar to the ones that you previously submitted with your extension application but with updated version or any other recent evidence, just to show them that "everything is still the same" and that you still maintain status/circumstance that you're previously granted, rather than just write them the letter only.

I know it's a bit of pain. Hope this helps.

Oh,ps. don't forget to send them by recorded delivery, you know what they're like!
