I just want to know that how long can i stay in my home country after my spousal visa has been issued without affecting the ILR which i will apply in the near future? i was granted my visa on the 18th of July 2012.

Really appreciate for your answers

@ash8055,

when i arrived UK (Birmingham Airport) , immigration officer just asked :

1 when did you get married.?
2 for how long is your wife/husband in UK?
3 who is waiting outside ?

just only three questions, then she put up arrival stamp on my passport. even they did not asked for any chest X-ray etc. i was quite surprised. :D

hope it helps..

Anyhow spoke to my local MP regarding my case, she has a requested a copy of grounds of appeal and corresponding supporting documents so that she can contact BHC to raise her concern on my behalf.

Will post any news as and when.

@batley khan

innyour opinion for an ecm to overturn a decision does it have to be astraight forward case. my case is more about an explaination of our relationship so in your opinion would you say an ecm would make the decision his/herself or forward it on to an immigration judge

If you provide evidence and they look at it, they'll overturn. No one wants to go to court and be humiliated by the judge, remember the judge is the decision maker then. The question is whether or not the ECM/ECOs bother to look at the appeal or if they have the time, both of which are inexcusable.

I don't want to dampen your spirits, but you're look at January sKaur if it goes the distance, so I'd suggest you hang in there now and start to kick up a fuss close to your deadline. Your case seems pretty simple to most of us, and it will be to the ECM if they look at it, so let's hope they look at it.

Thank you. I have another issue on my refusal well my husbands because my wages of my last statement were lower than my previous 6 months statements they had refused however when we applied i had said i recieve income from family ie my ex but had not wriiten that my mum has helped for the past three years since i left my ex husband as she owns her house and works also and recieves my late fathers private work pension. i hadnt wriiten this because obviously it is a cash in hand thing and my mum gives me money for when i went india as she feels its like her way of helping me . just wondering will a ecm consider this now even though i had not declared it at application time or will it go to courtbecause of this factor.

UK Spouse / Settlement Visa

Post by vj100 » Wed Aug 08, 2012 1:46 pm

Hi,

I am getting married next month in India, and going to apply for UK Spouse / Settlement Visa for my wife soon after the wedding / registar marriage. I am a british citizen and my wife is an Indian National. I have gone the through UK border agency website, so know what online form that I need to fill in but not very clear about what supporting documents that I need to submit. My wife will be applying for this Visa in VFS CHENNAI. I am thinking of going through a solicitor for help and advice, but they charge about £500 to help with the Visa. Not sure if its the right thing to do. Has anyone gone through this recently who can help me.

Is your TB test still valid?

If not you may consider re-doing it as they may halt you purely for medical checks at the airport. Most people have a valid TB certificate when they arrive, but some don't and are often kept at the airport for an extra 6/7 hours for some stupid checks.

Personally, I would go with getting a TB test done again in India if I were you and had the money, but it's up to you.

Lucy/Skaur/all

Submitted appeal on 20th July 2012. Been advised by FTTIAC that they will forward appeal to BHC Delhi tommorow 10/08/12. They expect BHC Delhi to receive appeal with a week.

However I received a call from BHC politely requesting me to send original candidate results sheet or deliver by hand. (visa was refused as they state we did not originally supply)

I guess this is a good sign? As they haven't yet received my appeal and appear to be actioning a review requested by my solictor.

Kindly let me have your thoughts?
